Designer on the original Macintosh testifies in Samsung patent case

Graphic designer Susan Kare, known for giving the Macintosh its smile through the “Happy Mac” icon, has been called to testify in the patent case between Apple and Samsung, CNET reported.

Samsung was found guilty of infringing Apple’s intellectual property in the iPhone six years ago. Apple has asked for over $1 billion in damages, and the court is hearing subsequent arguments.
 
Kare said there is no question that the icon grid patent applies to the phone in its entirety.

This is just ridiculous!

The icon grid is a pure software feature. So she is saying if you switch off the phone and no software is running the phone "in its entirety" is now supposed to stop/disappear...

You can still have the hardware without any software or firmware on the phone. Thus, you can remove that icon grid completely and still have the hardware!

I don't know who is more in error here, she or anybody who believe that nonsense?
