This is the first time that a company has actually ignored an ASA ruling and complainants has actually followed up on it, it seems…
 
Trust iburst to be the first to ignore the ASA................sorta fits with the way that company is run.................. does it not?:rolleyes:

Tell them to remove the shaping maybe this will improve speed "not". Well done Micheal it's about time someone shows them they are not above the law. Maybe get them to revoke all the contracts as the main reason they got the contracts was from false advertising. People can then re-apply for a contract if they feel like it.

Also, they have to rewrite their contracts that it's clearer and more completed, and also specifying what can and can't iBurst or the customer do. An impartial lawyer can give some input on this.

Both parties's rights need to be specified on the new contract, and there should be an escape clause for the customer.
 
I agree, remove all shaping! shouldn;t cost them anything and people will finally get the bandwidth they paying for.

Maybe force them to double caps or reduce pricing to...

Or maybe stop putting up towers in new areas and increase tower density in existing areas.

haha, yeah they sure winning as the worst provider SA has ever seen, and it's not going to be easy for any other provider to beat them thats for sure.:D
 
Refund the proportion of average bandwidth they are not able to provide.
So if they can on average only supply 80% of advertised speed, then refund 20% of contract value paid to date.

Seems to me like the punishment should fit the crime.
 
Not bad, but I think you going off-course of the original claim with points 3,4 and 5. Rather bring those up in new separate cases. Not sure if the ASA are the right people for those points.
 
Thanks Fudzy, my aim is to make iBurst acutely aware of their customer grievances’ as they will have an opportunity to review this document and by illustrating how unethical their behaviour is it also indicates that the adverts were purposefully not withdrawn and one can therefore safely assume they would do this in future again.

Request that an advert be placed by iBurst similar in length to the voilating advertisment. It should indicate details of their violation and an apology to their customers for inaccurate advertising.

The apology should be run for a term NO SHORTER than the term of the origional offending advert.

This will cost them dearly and actually get them to sit up and notice.

Add to that, that iBurst should advertise the apology advert in all publications, websites, TV, radio etc where iBurst originally advertised the false advertising :).

Also the apology adverts must have the same prominence as the original false advertising, i.e. if the original was full colour of size x*y in a newspaper or magazine then the apology should also be full colour of size x*y with the same font size etc.
