Following her death, the South African Police Service registered an inquest docket, whereafter extensive investigation was conducted to determine whether her death was caused by any criminal conduct on the part of any person.
“The matter was referred to the NPA, who in turn returned the matter to the South African Police Service for further investigation.
“Advocate Nicolette Bell, the director of public prosecutions (DPP) in the Western Cape, considered the merits of the matter, as well as various reports presented to her by her staff,” Ntabazalila said.
In the months that followed, the DPP was advised that Tembe's family wished to make representations regarding her decision to the national director of public prosecutions (NDPP).
As a result, the inquest regarding the death of Tembe was delayed pending representations to the NDPP, he said.
Subsequently, an application for access to the docket was served on the NPA in terms of the Promotion of Access to Information Act (PAIA) after an initial request to have access to the docket was denied.

The case was passed from pillar to post but eventually it was Tembe family attorneys that pended the PAIA application and had not lodged their representations to the NDPP.
Why was Moses Tembe no longer in a hurry to access the docket? He must have got his answer whilst still stating categorically that his daughter did not commit suicide.

Was tricky rescue a foretaste?
On December 11, Anele “Nelli” Tembe stood on a ledge near the top of the 19-storey Durban Hilton Hotel just before 8am. A risky rescue was planned over an emotional 50 minutes.
Sources with knowledge of the incident said Tembe was consoled and counselled by her cousin, who stood a few metres away, while a team of first responders and hotel staff worked in the background.
Tembe became emotional and distracted. In a split-second gap, police rescuers saw a chance to snatch her to safety.
Sources said Tembe was aggressive when they grabbed her. “Outside of an emotional state she was highly aggressive — she was clearly confrontational. ‘Leave me, I want to die’ ... she kept on saying that while fighting off the police.”
