ANC lays criminal charges against DA leader Mark Burke over crypto company

What exactly is illegal here?

SARB suspected breaches of certain regulations, but the court did not find Kastelo guilty of those breaches. If clients genuinely borrowed money and used their own legal offshore allowances for arbitrage, then repaid the loans, which specific act was illegal here?

That the ANC was not included or didn't think of it first.
 
If a political party in government resorts to laying charges at a police station, they have failed at the first hurdle. Why not with the Hawks, or someone with authority? The case will lay dormant, just long enough to act as political ammunition until the elections, after which it will be conveniently forgotten.
 
ANC overstepping as usual, but not in the least a surprise, we all know exactly who the cadre really are. That said, the courts need to make a determination on this quickly. Burke being a member, even if not an active one, of the company, will still be 'liable' if the company is found to have acted illegally. Here I specifically mean that his continued employment with the DA would be distasteful if he is shown to have profited through his association with the company's illegal activity. His position alone means that he would have been aware of the illegal activity and would have known it was illegal.
