Hi,

I was involved in an accident last month. My insurer has rejected my claim on the basis my policy was inactive at that point in time. is it possible to institute a 3rd party claim so as to have my car repaired? Please advise

Many thanks
Regards

So that's why you need a loan?

To answer your question yes you can claim against the other party's insurance if they were at fault but it may cost money to do so as often you need lawyers. Your insurance would ordinarily deal with it for you but seeing that you had neglected to pay them they won't lift a finger.

Unless you mean the RAF? No, they only cover injury and only if there is a third party involved.

Yes it is and half the work is done as you now have proof of no insurance.
Institute a claim against the 3rd party or their insurers.
Full details of incident make sure all their details are contained there in.
Attached a quote
Police reference number
Letter from your insurer
Copy of licence disc
Copy of your licence
Copy of registration papers.
Keep originals until requested
And await their response

Hi, yes, this is essentially why I need a loan. I need to get my car repaired

If you don't have enough and there's no engine damage rather do minimum repairs that get it driving. Then you can save and repair properly

Unrelated, but I was in an accident last year. 3rd party did not have insurance and my insurance company's lawyers are now trying to get my excess back. In the event they are not able to, is there any other way I can get this guy "punished"? I don't want him to get off scot-free.

They could attach and sell some of his assets to recover it.

Send someone with a baseball bat?

Actually, what you can do is get permission from your insurance company to recover your excess. Just remember that you ceded all your rights to them when you lodged your claim. You are therefore not entitled to recover the excess yourself without their express permission.

Have you gone back to your own insurance to make a deal or ask why it was only put in place on the given dates?

Or did you knowingly go without insurance for a few days?

Ja that'll prob be the route they'll take, but I don't think the car even belongs to him, young laaitie so wouldn't have any assets. I'm just thinking worse case now already.

You know that was actually what we agreed upon in the beginning, but he was taking his own sweet time and became hardegat so I decided to go through my insurance instead.

The OP hasn't even said what happened, he's got no chance of a claim against anyone if the accident was deemed his fault.

The other party might be coming after him as well if he doesn't have insurance and caused the accident...
