A legal question

It's verbal and much harder to prove, but you have an agreement.
 
Yea , 100% right there .. if its not in writing , its not there.
Also , if there is a contradicting statement at the end of a contract , than whats said in the beginning of a contract , the final statement at the end of the contract would be in effect. Thats how I ended up paying the transfer fees for selling my house , beginning of the document said the buyer pays it , end of the contract said in convoluted terms that I carry the transfer fee. So after many lawyers fees Im still screwed , ALWAYS have your lawyer read any contract before you sign it. ALWAYS.

Correct. But where there is a written contract in existence it takes precedence over any other verbal agreements. He could sue the lawyer and try to prove that the lawyer said what he did.

But then he will have lost more money than this contract is probably for. It takes money to prove things.
 
Send them an email , try to get him to admit that there was an agreement. ie. .... regarding the agreed settlement payment, I see the date we agreed on has passed and I have not received the funds. Please could you be so kind as to tell me when you will be effecting the transfer.

This way if he replies saying he will pay on x and x date he has basically admitted there was an agreed on date and you can take matters from there.

quite often in written contracts there is terminology that only what is reduced to writing is binding. running away from this very sort of thing.
