Maybe people would like to agree and dissagree with me on this.

(I would like to say that the following information is probably totally incorrect, and that I dont know who sentech is and what they do, and I dont even have a degree... in anything (have to fix that), and that's why I would like to have this open for discussion ;) )


I always read contracts through before I sign them, some places find that anoying. Sentech's contract does not vary much from celphone providers. You could look at sentech as a celular provider, just in this case, it's internet. They give you a modem (cellphone) and after 24 months it's yours. I dont know if any of you have tried, but you cannot at all, in anyway cancel your contract with a cellphone provider before the end of the period. You cannot even pay ahead the amount outstanding (Geuss why I cant go back to germany anymore). People seem to be very skeptical (spelling) about this, but I wonder if they have had a cellphone contract before.

It's true, cellphone providers have pay as you go and so forth, but sentech I geuss is different in that aspect. I'm sure if they really wanted to, they could give you that (possibly) R83 off per month that the modem might cost. But mtn doesnt do that, and why not make sure sentech stands strong with revenue and let them rip us off, so that we know that they'll be here long, and offer even better service in the future. Service = Money ;) Atleast I would think.

The contract itself ... Yes rather scary.

Point 3.5, Sentech shall be entitled to ... discontinue... suspend ... disconnect ... at any time , seems to be what some people read. Further it states in the event of ... breaches of contract type stuff.

So from that, obviously in this area, they cant just go nuts on you whenever they want.

Point 4. About the duration, from my understanding , your contract will continue after the 24 months, unless you terminate it.
-> just like cellphones ;)

6 -> You cant hold them liable for anything.
All companies use that, else my insurnace copmany would be broke.

7 -> You dont pay, you cant play.

8 -> Service - They actually state that they will give you service.
Most companies Ive worked with suffer though in getting it right.

9.5 -> Acceptable use policy, from what you can see on /., most broadband providers and mweb 56k modem contracts specify this. Please show me the internet contract that does not have this.

10 -> Still cant be held for liability
10.7 -> You dont pay them ... eveyone will know

11 -> Agree to abide some laws and random things

11.1.1 -> Be able to tell you that your abusing theire bandwidth
11.1.3 -> Only used aproved devices ... interisting, but this prevents service hacking (loopholes in the hardware and firmware)

12 -> The lovely one,
12.1 -> They can disconnect without notice, to do some other things, like fixup the network, so that your internet connection can be even faster, or for other reasons)
12.1.1 -> They will try to do it as fast as possible

12.1.2 -> If you dont do what they say, or pay them , kiss your 128k goodbye ... 256 ... 512
12.2 -> You still pay if your suspended.

13 -> Termination and breach
13.1 -> you dont pay you cant play stuff


13.2 -> Now this one does confuse me a bit (I'm probably not too bright)

13.3 -> They can terminate you connection whenever they want .....
If you dont pay and if you
If you are broke
If you dont listen
If your not allowed to use it (arrested hacker)
If they cant deliver service to you for 60 days <----- Nice ;)


16 -> They can change agreement or pricing.
I have had my insurance go up 1 time every year, and cellphone the same ( if not 2 times), Now where is this a problem ? It's standard with most contracts. (Unless you get a fixed rate bond ;)

18 -> They will charge you a reasonable fee if reconnection and blah blah blah.
Before trolls jump to conclusions, if you felt it's not reasonable, you can take them to a small claims court, and let the judge decide. If he decided it was not reasonable, then sentech would not be able to do it. So it's not just up to them.

19 -> Relaxation ... is this what I think it is ? (if it is ... how nice)

20.1 -> Why do I always see this citandi exublah stuff ;) And never know what it means. Anyways, something todo with your address? hehe

21 -> They have electronic proof ;) Just like banks

22.1 -> If you dont pay, or do something that they said you cant do, and you give us downtime and we moan about it, they can charge you for damages ;) Perfectly fine by me.

25 -> The court has jur dick... anyways, it's legal ...

Now, how many people have I seen post on it-web and other places stating that sentech can revoke your contract whenever they want ?

No offence, but if anyone doesnt pay sentech, I want theire contract revoked, because it's loss of money to sentech, and they need the money to make my experience better.

Someone mentioned something about no protection for the user.
This document has allot of protection for you. Now I think that is very nice of them.

And well, the people who have said that this contract is questionable, like on itweb, where do they get that from ?
Are they still in school and never signed a contract before ?

Lastly, I am no professional, I can garuntee it. These terms and conditions can be found on their web-site. I dont say anything above here is right, and cannot take liability for your actions, except if you scratch my car. I would like to hear from people about the ones I'm not sure about, And from people that think the contract sucks, and why (But in this case please dont bring up something that is stated in every other contract all over the world).

Generally speaking, I like the contract. Any opinions ?

Domicilium Citandi et Excitandi is, I believe, your location for purposes of legal activity. In other words, that's where they'll try and serve you a summons, or accounts, and stuff. (IANAL) What I would like to see is a lawyer commenting on the legality of the contract; are all of the terms and conditions that they present really legal? For example, the clause that states you have accepted the AUP found on their website; can you really agree to a document that might change at any time, without signing a copy of the document itself?

I also dont like the 'change at will thing'
But everyone uses it.

And yeah, you look about right on that ex dum stuff ;) hehe
