Good day,

PLEASE HELP!

On a rainy day, I was driving straight and a person decides to indicate, and put her edge out of her lane (right) to come onto mine (middle). Due to her sudden change of lane, I was unable to break in time and crashed my front right onto her rear back. She says that it's my fault as I crashed into her. She wants my insurance to pay for her damages. I don't know what to do.
 
Mud wrestling is the usual way to settle these things but wet T-Shirt contests are a classic you can revert to.

You would need to submit a police statements and such detailing what happened in the accident. Ideally you would also have eye-witness statements which corroborate your statement.

You do nothing, Your insurance handles it, That is why you pay them.

For all we know you could also be lying. Why must your version be believed?

That's cause you don't need to do anything, why do you think you need to do anything?

You just inform your insurer of the accident and you give her your insurers details and don't accept dealings with her directly at all and refer her to insurer if she contacts you. That's what you have insurance for.
 
Dash Cams for the win... Similar thing happened to me. Send camera footage to the insurance. A year later, my excess was recovered from the 3rd party and I was refunded :) In my case, the guy changes lanes without indicating, directly into me.
 
Agreed with everyone else. Forward all this details to your insurance and leave this in their hands. Don't get involved and don't reply to any messages. Do not try to be a nice person, people will screw you over.
 
Thank you for the responses guys... I want to claim from Insurance but they are saying that my premiums will go up along with me paying an excess amount. I'm on Miway... How do I get the other party to cover my damages as she doesn't want to give any of her insurance details?
 
Assuming OP was driving correctly with the accident being the other persons fault and there were no witnesses. How does he prove his case? Surely the insurance co is going to need proof to work with otherwise its all going to be blamed on OP.

I dont think you should have let her go without all the details. i assume you both went to a police station to file a report

That's how it works, you pay an access as per your policy document (read your policy document!). If you don't like the excess when taking out the insurance and getting your policy document you either have to negotiate with them at the start, or look for another insurance provider whose excess you like more.

You might even get the excess back if they are able to recover the money from the other person.

As to the premiums increasing, wait and see if it does, if not happy, get another insurer.

And if other person doesn't want to provide hold them against their will? :p Nope! You take other persons details that they are willing to give you, note things like cars nr plate and make and model and such. Take photos of scene and damage if you can.
 
:crylaugh: I didnt mean it like that. But the fact that she doesnt want to give her details makes her look guilty to me.... or maybe she doesnt have insurance.:whistle:
 
You give all the details to your insurance company after getting a case number from the police station and let them sort it out.

That's what you pay them for.

If they deem the accident the fault of the other driver you may get your excess back eventually...however since you drove into the back of her car it's unlikely the majority of the fault won't be yours.

You could do a third party claim against her insurance...but since you don't have any details this really isn't going to help you much and the odds are you'll lose anyway.

So just use your own insurance. Your premium would only go up if it was deemed your fault and rightfully so.
