Hi,

I recently met in a small accident with someone. No injuries and minor damages.

The other guy has asked me to request from my insurance to him an email containing the form that needs to be filled in stating that we aren't claiming from our insurance?

Is this normal?
Do I just contact them and ask them this?

Give Insurance the other guys details and let them sort it out.

That's what you pay them for - so you don't have to worry about **** like this.

He probably wants assurance that you will not claim from your insurance, which in turn might fight with his insurance if it was his fault and therefore making him subject to some excess charges.

You may tell him that he can contact your insurance directly. You don't even have to contact your insurance to give them HIS details. Obviously from an ethical point you may help a bit though lol

Report the accident to your insurance and then leave it there... you pay them to sort this out.

Don't forget you need an AR number, be sure to report it to the police within 24 hours.

Where did this fallacy originate?

http://www.saps.gov.za/faqdetail.php?fid=10

The driver of a vehicle at the time when such vehicle is involved in or contributes to any accident in which any person is killed or injured or suffers damage in respect of any property, including a vehicle, or animal shall if he or she has not already reported the accident to a police or traffic officer at the scene of the accident, and unless he or she is incapable of doing so by reason of injuries sustained by him or her in the accident, as soon as is reasonably practicable, and in the case where a person is killed or injured, within 24 hours after the occurrence of such accident, or in any other case on the first working day after the occurrence of such accident.

To play it safe just report any accident within 24hours, no use trying to argue there was no deaths/injuries.

Unbelievable how many people use the roads with no clue as to the laws governing said use.

and in the case where a person is killed or injured, within 24 hours after the occurrence of such accident

When the OP expressly said that there were no injuries, please explain why your quoted text says it must be reported within 24 hours?

"OR SUFFERS DAMAGE IN RESPECT OF PROPERTY INCLUDING VEHICLES"

sheesh. Reading's hard, hey?

24 hours for death/injury
first working day for damages

At least that is my reading of it.

Yeah that is pretty much how I read it..

But I treat it as 24 hours for any type of accident... just keeps things simple and cop shops are open 24 hours so may as well just get it over and done with.
