Advice with domain name usage query

Hi, i am not sure if this is the correct place to post this but any insight appreciated.

I develop web sites and i have recently registered a domain name evolutionconsulting.co.za for a company called Evolution (evolution.co.za was not available). One of the services that evolution offers is consulting - to the fashion and various other industries. My client then Googled (local pages) evolution consulting and came across a web site Evolution Consulting http://www.evoco.co.za which looks to be part of Discovery. The web site is under construction. My client has raised the question as to Evolution's right to use the domain name evolutionconsulting.co.za and whether evoco.co.za has the right to dispute the use.

I have done some reading at http://www.domaindisputes.co.za/ and have had a brief look at the ADR regulations but am not a legal person so not really qualified to make an informed decision.

Any advice, comment on whether my client is at risk?

AFAIK it comes down to is "Evolution Consulting" a trade name or trade mark. If yes then you are going to have issues. Check out the name with Cipro and you may need to talk to a copywrite lawyer. And knowing Discovery they will have a go at your client even if they don't have the right to. They are bullies.

its difficult since both companies have legally registered names, and hence have legal rights to them. Maybe give AdamsAdams a call? Are they still going? dont know if they would charge for that kind of info but better to get a proper hard-copy response.
