Port Elizabeth – The case against two African National Congress (ANC) councillors from Nelson Mandela Bay, who are facing charges of assault with intent to cause grievous bodily harm, was postponed in the Port Elizabeth Magistrate's Court on Tuesday.

The charges against the councillors relate to a violent brawl which broke out during a council meeting in November last year. Gamalihleli Maqula, 28, appeared briefly in court on Tuesday but Andile Lungisa, 39, was not at court proceedings and the state was provided with a medical certificate.

Nelson Mandela Bay council brawl case postponed again

The case was postponed until August 16.

The case against two African National Congress (ANC) councillors from Nelson Mandela Bay, who are facing charges of assault with intent to cause grievous bodily harm, was postponed once again in the Port Elizabeth Magistrates’ Court on Thursday.

Lungisa believes NMB council brawl case will collapse

Port Elizabeth - African National Congress (ANC) councillor Andile Lungisa has vowed that the Nelson Nelson Mandela Bay council brawl case will continue to be postponed until it goes away, he told a group of supporters outside the Port Elizabeth Magistrate's Court on Wednesday.

The charges against councillors Gamalihleli Maqula, 28, and Lungisa, 39, relate to a violent brawl which broke out during a council meeting in October last year.

The pair appeared briefly in court on Wednesday where the case against them was once again postponed.

Defence attorney Luthando Nqgakayi told the court that he had submitted representations to the Director of Public Prosecution (DPP) and he was awaiting a response which could possibly affect the provisional trial dates.

"We can't preempt the outcome, if it is not successful I may receive instructions to make representations to the national office," said Nqgakayi.

Both the councillors were excused from their next court date on September 14 when their lawyer is expected to advise on a way forward.

The provisional trial date has been set down for October 25.

Media barred from covering Andile Lungisa's assault case

Port Elizabeth - Media were barred by security from attending open court proceedings in the case against ANC provincial heavyweight Andile Lungisa at the Port Elizabeth Magistrate's court on Monday morning.

Lungisa and Gamalihleli Maqula, both ANC councillors in the Nelson Mandela Bay municipality, are facing charges of assault with the intent to do grievous bodily harm, relating to a brawl in council chambers in October last year.

Lungisa is accused of smashing a glass jug over the head of mayoral committee member for transport, Rano Kayser, while Maqula is accused of stabbing chief whip, Werner Senekal in the back with a sharp object.

Media denied access to open court

The matter was set down for trial to start on Monday at 09:00, but when a News24 correspondent, along with other media representatives, arrived at court, they were denied access to the building and asked to step aside and produce their media cards.

Upon producing the relevant identification, they were still not allowed to enter and detained a further 15 minutes, until concerns were raised that the case may have already started. Media were then made to sign an attendance form, before being allowed to pass through the security checkpoint.

Upon arriving outside court 22, where the matter was to be heard, additional security members again prevented the media from entering the court room.

These security measures are not standard procedure at the PE magistrates court, although similar security was encountered during appearances of Nigerian pastor, Timothy Omotoso.

However, in the Omotoso case, there have been hundreds of the charismatic pastor's supporters protesting outside and trying to gain access to the court, whereas in this case the court itself was all but empty.

Numerous requests to be allowed to enter were ignored, even after the media representatives saw witnesses and the two co-accused enter the courtroom. One security guard even checked and reported that the matter was already underway, but still refused media entry.

Only after the matter was escalated, were media allowed to enter, having missed the state prosecutor’s address to the court and catching the tail end of the defence’s address to magistrate Morné Cannon.

Attempts to get comment on why the media had been prevented from attending court have been unsuccessful.

Security officials said they were not allowed to comment to the media. National Prosecuting Authority spokesperson, Tsepo Ndwalaza referred queries to the Department of Justice’s Mthunzi Mhaga.

Mhaga had not responded to SMS or WhatsApp queries at the time of publishing this story.

Lungisa a controversial provincial ANC figure

Lungisa has been surrounded by controversy this year. He was elected and endorsed by President Jacob Zuma as regional chairperson of the ANC in Nelson Mandela Bay, before being ordered to step down.

He subsequently stood for the position of ANC provincial secretary, as part of the team behind former chair and Eastern Cape premier Phumulo Masualle. The provincial elective conference, held in East London, however it descended into chaos.

When the elective conference reconvened, Masualle’s supporters were not present and Oscar Mabuyane was elected as Eastern Cape chair of the ANC.

An open letter by Ace Ncobo, Fifa accredited referee and ANC party member, claimed Lungisa was behind the chaos at the conference that saw some members admitted to hospital. Lungisa has denied the allegations, saying Ncobo was a liar who had no known record in politics

A court case is scheduled to be heard in East London later in November, to have the elective conference overturned.

State makes impassioned plea for trial to begin

Following proceedings, News24 sought copies of the court record, which showed that state advocate, Wayne Ludick, had made an impassioned plea for the case to proceed to trial, due to the numerous postponements that had already taken place.

The case has already been postponed in March, April, May and August this year.

Luthando Ngqakayi, for the co-accused, said they had launched an appeal to the national director of public prosecution to have the case reviewed and the charges dropped against his client.

Magistrate Cannon then set the matter down for trial, to be heard on January 22 next year and, if need be, January 23.

Andile Lungisa assault trial: Damning video played in court

Port Elizabeth – A damning video was entered into evidence in the assault case against ANC provincial heavyweight Andile Lungisa in the Port Elizabeth Magistrate's Court on Monday morning.

Lungisa and Gamalihleli Maqula, both ANC councillors in the Nelson Mandela Bay municipality, are facing charges of assault with the intent to do grievous bodily harm, relating to a brawl in council chambers on October 27, 2016.

Lungisa is accused of smashing a glass jug over the head of mayoral committee member for transport, Rano Kayser, while Maqula is accused of stabbing chief whip Werner Senekal in the back with a sharp object.

They both pleaded not guilty as the trial got underway.

Damning video shows Lungisa smashing jug over Kayser

State prosecutor Wayne Ludick opened proceedings by calling DA councillor Renaldo Gouws to testify. Gouws took a series of videos during the commotion in council, which were then entered into record.

In the one video, Lungisa, wearing a suit and salmon pink shirt, can clearly be seen attempting to gain access to the speaker’s seat, which is on an elevated platform, in front of council.

Kayser can be seen approaching Lungisa and trying to take a glass jug out of Lungisa’s hands. Lungisa then raises the jug, as Kayser’s arm goes up in defence. Lungisa then slams the jug down over Kayser’s head. The glass jug shatters and water spills everywhere, as Kayser drops to the floor unconscious and bleeding from a gash to his head.

Gouws testified that he had recorded proceedings as had felt threatened by the behaviour of the ANC councillors who had become unruly when one of their councillors, Xola Sabani, had been asked to leave the chamber.

Gouws said he had not recorded everything, as he had been pointed at while recording, and he had not wanted to provoke tensions. He had, however, recorded when he noticed Lungisa approaching council speaker Jonathan Lawack with a jug of water in his hand.

"It is a firm rule that you do not approach the speaker," he said.

During cross-examination, defence attorney Luthando Ngqakayi pointed out that Gouws had also breached council regulations by making the recording.

Gouws said he had admitted to making the video and had paid a R50 fine for doing so.

"I didn’t throw a jug or break it over someone’s head," Gouws added.

Ngakayi said Lungisa would testify that he had only approached the speaker, as he was head of the ANC caucus at the time and he wanted to get Lawack’s attention.

He also asked if Gouws was not perhaps biased, as he was a DA councillor, to which Gouws responded that he was not.

Ngakayi pointed out that, at the time that Lungisa struck Kayser with the jug, there had been four people surrounding him. He said his client would argue that he felt threatened and had acted in self-defence.

'That’s when all hell broke loose'

Testifying after Gouws, Lawack said he had asked councillor Sabani to leave the chambers because of his unruly behaviour. In the video, Sabani can be seen banging his feet on the table.

He said, when Sabani failed to do so, he had instructed city manager Johan Mettler to get security to remove him, as he did not have the authority to do this himself.

Lawack said matters had escalated when ANC councillors prevented the security guards from reaching Sabani.

"That’s when all hell broke loose," he told the court.

He said two councillors - Lungisa and another ANC councillor, Makhi Feni - had approached him.

"It was clear from their approach that their intention was to intimidate me and attack me physically. Their intention was clear, they meant business," he said.

Lawack said Feni had reached him and grabbed him by the arm, before being blocked by a director from his office who had been seated next to him.

He then witnessed Lungisa attack Kayser. He said he had seen Kayser fall to the ground, bleeding profusely from a gash to his temple.

The case continues.

Imagine having that guy as your defense attorney. There is a video of his client smashing a jug of water over someone else, but he is complaining about the person who took the video.
