when I read the judgment it was clear that SAPA had missed the mark. but compared to some of the other missing of the mark it was really minor and undoubtedly the ANC would bitch to get a correction. Sadly the correction is could be improved - as it is potentially misleading in the context of the correction:

I can't establish whether other political parties have returned their funding from the Kebble slush but I strongly suspect that the DA did return the money after legal action was instituted.

The ANC brought an application to amend their defence against the summons in SGHC 2231/2008 and lost that application after the court found the defence given to be "a model of inept clumsiness". While the description of court action instituted would ordinarily exclude such an interlocutory application the inference which the ANC wishes a reasonable person ready the apology to draw is that the ANC has not had any adverse findings by a court outside of the failure of their application to the Western Cape High Court. The combination of both statements are misleading as the action brought by the trustees has come to court and there has been a hearing where an adverse ruling against the ANC was delivered, but it has not been finalized.
