Johannesburg - The ANC filed an application for leave to appeal against the ban on the controversial song Dubul' iBhunu (shoot the Boer), the Sunday Independent reported.

The ANC said it formed part of the history of its liberation struggle and was still sung by its supporters, the newspaper reported.

This application was made on behalf of the ANC by deputy secretary general, Thandi Modise, before the South Gauteng High Court.

"I respectfully submit that judicial notice can be taken of the fact that the song in question is known and sung by literally tens of thousands of South Africans. The consequences of a violation of this order are self-evidently prejudicial," Modise said.

She said the song formed part of the "history of the ANC's struggle for liberation," the newspaper reported.

"It is a notorious fact that the song in question has been sung by members and supporters of the ANC in diverse occasions."

The application follows a ruling by acting South Gauteng High Court Judge Leon Halgryn, who in March said the singing and publication of the song was "unconstitutional and unlawful" because it satisfied the crime of incitement.

The matter would appear before the court on November 29.

It's what kept Bob Mugarbage in power for so long, so why won't it work here.
 
If that hate speech and deviant variants of it is allowed again then so must "kill the ANC" songs be allowed as well (some ANC supporter might actually listen and vote for a different party next time).
 
Edit: Probably best I not say anything. What can one possibly say against ANC that will not be reported by some as racist. I give up.

I cannot see this appeal being upheld.

If they somehow manage to succeed, it will create a precedent for similar vile phrases to be sung aloud in public places (and, no, I will not mention any of them here or anywhere else).

This will ratchet up racial tensions in OUR country prior to the local municipal elections, to be held next year, to an unacceptable level that not even the ANC will be able to justify or control.
 
They can't really control it anymore if you ask me...

There own members spout racist vitriol at almost every turn nowadays.

The riots at Sun City regarding the Nelson Mandela song spring to mind. Then the Nelson mandela song (also equally "NOTORIOUS') must also be allowed back.

Actually, the song must be allowed to be sung legally, then the boere can equally legally defend themself against those that invade farms whilst singing.

Well that's because everyone thought it had died when that chop, Peter Mokaba had stopped. According to Wikipedia, the "Kill the boer" chant was revived at his funeral in 2002. However it is a different kettle of fish when youth league leaders sing it because he (Malema) is speaking to a much broader audience which increases the chance that some psycho might take the chant literally.

Words like "great struggle", "kill the boer"...one would swear that apartheid was still rife. Notice this thread isn't getting much response to provocative posts because most south africans have moved on and are doing their best to live in harmony, while the ANC does their best to propogate terrorism with songs like "bring my machine gun", "kill the boer".

Geez, what type of government would want to kill its fellow citizens.
 
Why the surprise? The ANC has NOTHING to offer for the future of this country. All they can do is dredge up the past to remind their peons of the "glory days." Scum.
 
This government has lost direction and initiative if these are the types of juvenile issues they take up arms for, when there are so many other bigger problems in this country I could not even begin to start listing them.

/unimpressed.
