'Vampire’s' occult interest comes up in Anika inquest

Pretoria - An inquest at the Pretoria North Magistrate's Court into the unsolved 2010 murder of Pretoria schoolgirl Anika Smit centred on Wednesday morning on a fellow pupil's apparently short-lived interest in the occult on Court.
The body of the fresh-faced, blonde Anika was found with her hands chopped off. She had been raped and her throat was slit. Her hands were never found.
The family and girlfriend of a young man, who went by the Mxit name of “Vampire”, have repeatedly been asked whether he was interested in the occult.
“Vampire's” girlfriend, who called herself “Penguin” on Mixit for her love of the animals, said that although her boyfriend had once expressed curiosity in the occult, as far as she knew he took it no further.
The two may not be named in terms of an order by the court.
'Was he involved in Satanism?'
Prosecutor Tania Carstens asked the young woman if her childhood sweetheart had been involved in Satanism or “anything goth” and whether she knew about a book of spells he supposedly had.
“Yesterday on the news was the first time I heard that,” she said of the spell book. When asked about his beliefs and practices, she said she was not sure.
“I had my suspicions but I never followed it up. I think it was more of a front,” she said.
''I questioned him once and he said he had shown interest but it did not really interest him. I think he did research and asked questions but I don't think he would actually do it.''
Like any teenagers, they watched horror movies she added, saying she preferred vampire movies, and also read books about vampires. “I think it is interesting but you won't get involved because it's fiction.”
She had never heard of anybody drinking blood at parties and said this was not in line with her own Christian beliefs.
She was brought up in the Dutch Reformed Church, but was now a Seventh Day Adventist.
She started crying when asked about a message she had sent her boyfriend in 2008 asking him to get rid of someone.
She said the message related to a man who was abusing someone close to her.
But she added she would never ask for him to be killed. The message was stupid, she was young, and she deeply regretted it. “You can phone his [the allegedly abusive man] cell number now and you will see he is alive,” she said.
Drinking a mysterious red substance
She was also questioned on whether she knew another Mixit user named “Satan's Eyes”.
“Vampire” had allegedly asked “Satan’s Eyes” for help in getting rid of someone for “Penguin”.
But it was a picture of a man not yet identified, drinking out of a blue striped glass with something red on his lips that has been described as blood, and another of a man holding a sword that caught the magistrate's attention.
On Tuesday, “Vampire's” mother and sister denied knowing who it was but after being shown pictures of “Vampire's” bedroom, Magistrate Pierre Wessels picked up that the curtains behind the mystery man appear to be the same as those in “Vampire's” room.
The inquest will continue after the tea break.

Pretoria - A young woman spent Wednesday being subjected to endless questions over what her boyfriend did the day Anika Smit was murdered and her hands cut off.
Much of the questioning revolved around scratch marks that appeared on his body around the time Smit died, and whether her boyfriend, who she described as a bit of an outsider who hung out with the smokers, had anything to do with the occult.
She insisted that the scratch marks were from an incident in which her boyfriend picked his sister up and carried her inside the house when she was about to storm over to her former fiancé's house about a message he had left on Facebook.
She painted a picture of them as an inseparable couple who sent each other love poems and said he had even written a song for her.
He was at her house almost every day and would return to his own house late at night.
On the day in 2010 when Anika was murdered, she remembers that they fought before school over a letter a girl in a lower grade had sent him, and she ignored him for a while, then sent him a text message asking where he was.
He said he was at home and after school, he gave her a teddy bear which he had bought after selling his violin.
She said she did not know Smit, who was in a lower grade, apart from by sight, and did not follow the finer details of Smit's murder because she was overwhelmed by her own issues - the domestic abuse of somebody close to her.
She was upset by Smit's murder, though.
She explained that she met her boyfriend on a Mxit group set up by a friend and she went by the user name Penguin, and he as Vampire.
But, in spite of relentless questioning over the possibility that her boyfriend was involved in the occult, she said the vampire thing was just something teenagers were interested in.
She was a churchgoer, and he had been confirmed into his church. A Mxit message to him to get rid of somebody was not serious, it was just stupid, and she deeply regretted it.
She quipped that the court could phone the man the message was about and confirm that he was still alive.
Shown the front cover of a book of spells allegedly found in her boyfriend's house, she said she had never seen it before.
The court was also shown a picture of three different calibres of bullets found in his home. She said he was due to inherit two firearms.

Prosecutor Tania Carstens asked that the public gallery be patient while the various lawyers examined copies of the book to prepare their questions.
The young man, who goes by the Mxit user name "Vampire", has been the focal point of much of the questioning into the blonde high school pupil's death at home in Theresa Park on March 10, 2010.
Her father Johan found her body. She had been raped, her throat was slit and her hands had been chopped off. Anika’s hands remain missing.
On Wednesday the young man's girlfriend was questioned for the whole day, answering a range of questions including when they started having sex. She had to defend her own interest in films and novels about vampires, which have swept the teen literary and film scene in the past few years.
She seemed almost embarrassed to say that she read the books, but added she had never been around people who supposedly drank blood, because it was against her Christian faith.
Book of spells seized
She was also asked if her boyfriend had ever attempted to have his eye teeth altered to look like a vampire. He had not, she said.
But mostly, she was questioned about scratch marks on his body, which his mother, his sister, and his girlfriend have said was when he tried to carry his sister inside when she was about to storm off to her ex-fiancé’s house over a Facebook post he made.
A message sent by “Vampire” to another user named "Satan Eyes" relating to a spell to get rid of someone also came under the spotlight.

Pretoria - The young man questioned about teen girl Anika Smit's gruesome murder, testified on Thursday how he drank blood at a “vampire” party.
He also spoke frankly about becoming friends with a group of Satanists.
He may not be named and has not been charged with anything.
He is known as "Vampire" on Mxit. He resignedly answered the questions put to him by Prosecutor Tania Carstens.
Even his handwritten poetry was laid bare, his words of despair read to the court.
The public gallery at the Pretoria North Magistrate's Court leaned forward as he spoke of how he went to a "Vampiric Party" where they had to drink a tot of blood.
Asked by the prosecution what went through his mind when he drank the blood, he said: "Wat de donner doen ek? [What the hell am I doing?]"
But, even though he was copying spells off the internet, and was protected by the boys who said they were Satanists from school bullies, he said he was nowhere near any actual initiation rituals.
The party and any discussions about Satanism were more of a show of some of the things Satanists did. It was more of a pre-recruitment display, he said.

He said he first heard of Satanism when his father became angry about a film one of his brothers was watching and called it "Satanic". He was in primary school at the time and out of curiosity went to the public library, and for about two weeks read up on it, but quickly lost interest.
It was only when he was in high school that his interest resurfaced when he connected with a group of boys interested in Satanism. One in particular called himself a Satanist.
Once he started hanging around with them, if anybody tried to pick on him, the group interested in Satanism would back him up, and the bullies would back off.
He said he was picked on because he was thin, in spite of how much he ate at home.
He changed schools in Grade 10, but his reputation as a Satanist and as a boy always taking part in fights followed him.
But by the end of the year at his new school, he received an award for good behaviour.
However, he led a secret life of emotional turmoil, not talking about how he was being bullied. He thought about suicide often and tried to kill himself with tablets.
Smit's hands were chopped off and never found. Her father found her body at their house in Theresa Park. Her throat had also been slit and she had been raped.

"Everybody that walked through the door [got a shooter of blood]," he said matter-of-factly.
Prosecutor Tania Carstens said that if anybody gave her a shooter glass containing what looked like blood, all sorts of things would go through her mind, including "what is it?' and the thought of HIV/Aids.
"I was young and stupid," he said.
Carstens asked: "So it was just, 'welcome here' and swallow?"
"Yes," he said.
The court has ordered that none of the witnesses be named.
'What the hell am I doing?'
Earlier she asked him what had gone through his mind when he drank it and he replied, "What the hell am I doing?"
At the party he saw people drawing blood with syringes.
"They drew blood then drank it. It was possible that it was human blood," he said in reply to Carstens's questions.
Apart from that, the usual party refreshments such as alcohol were available.
He could not remember who invited him to the party, but had said that it was a vampiric party.
The court heard earlier that he became friends with a group of boys at his high school who were interested in the occult, because they protected him from bullies. If anyone picked on him with his slight frame, the boys would assist him and the bullies would back off.
One in the group described himself as a Satanist.
He said the party he had described was more a show by his occult friends, and had nothing to do with initiation rituals that he had had nothing to do with.

He became friends with them when he realised they would have his back when he was bullied. But when he changed schools hoping for a fresh start, his reputation of being into the occult followed him.
At his new school, he met his present fiancé - but five years since the death of Smit, he said they had been subjected to thorough, and at times, very personal questioning about their lives.
On Thursday, the court heard that while he had been to the front of Smit's house, it was because she and his good friend had walked home together. He had never been inside the house where her father Johan found her dead.
When they walked home together, he waited outside and her male friend, who was also his close friend, went inside for a short time, and then came out.
The young man said he was taken in for questioning twice over Smit's murder - the first time because he had bunked school on the day she was killed, and the second time, because he had scratch marks on his neck.
He explained that he had bunked school to buy his fiancé a tiger teddy bear because they had had an argument. The day Smit was murdered, he went to sell his violin and used the estimated R200 to R300 he had received for it to buy the reconciliation gift.
That weekend, he intervened when his sister was trying to storm out of the house over a Facebook message her fiancé had posted. He carried his twin sister, who is five minutes older than him, up the steps and while she was flailing against him, she had scratched his neck.
This was shown on a photo he was tagged in from a party he went to that Saturday night.
He said he knew Smit, but not that well. He knew she smoked, and had heard stories involving alcohol.
He had had a torrid time at school, feeling suicidal and self-harming with blades. He now had a job at a cellphone tower maintenance company.
But it was his recounting of being given a blood shooter at a party he was invited to, and his observing other people at the vampire party drawing blood and then drinking it, that had the public gallery leaning forward in the benches.
The inquest continues on Friday.

The young man said he was taken in for questioning twice over Smit's murder - the first time because he had bunked school on the day she was killed, and the second time, because he had scratch marks on his neck.
He explained that he had bunked school to buy his fiancé a tiger teddy bear because they had had an argument. The day Smit was murdered, he went to sell his violin and used the estimated R200 to R300 he had received for it to buy the reconciliation gift.
That weekend, he intervened when his sister was trying to storm out of the house over a Facebook message her fiancé had posted. He carried his twin sister, who is five minutes older than him, up the steps and while she was flailing against him, she had scratched his neck.
This was shown on a photo he was tagged in from a party he went to that Saturday night.
He said he knew Smit, but not that well. He knew she smoked, and had heard stories involving alcohol.
He had had a torrid time at school, feeling suicidal and self-harming with blades. He now had a job at a cellphone tower maintenance company.
But it was his recounting of being given a blood shooter at a party he was invited to, and his observing other people at the vampire party drawing blood and then drinking it, that had the public gallery leaning forward in the benches.
The inquest continues on Friday.

After the post was raised at the beginning of proceedings, Carstens applied for the inquest to be held in camera but Anton Van Staden, who is representing Anika's then-boyfriend Nico Venter, objected saying that his client's identity had been splashed all over the media when he was arrested and then later released.
Wessels said even though Treeby could be named and his photograph could be published, he asked the media not to rush at him with flashes.
He said Carstens must be given time to explain the ramifications of the turn of events.
Any other witnesses in the inquest so far may still not be named.
After consultation with Carstens, Treeby indicated that he would like the support of a legal representative for the rest of the inquest.
He has testified about his despair at being bullied and how he became friends with a group of people at school interested in the occult because they were protecting him from the bullies.

On Thursday he told the inquest that he had been to a party where shooters, which may have been blood, were given to guests at the door. People were seen drawing blood from one another.
He had also researched the occult and spells.
He said he knew Anika and they walked home from school together sometimes - one of his friends was attracted to her - but he did not know her well and had never been in her house.
While the court was fixing a return date, all the lawyers present offered to reach out to their colleagues to find a lawyer for Treeby.
Wessels said that if he felt his life was in any danger, Treeby should immediately contact Carstens.
Later Carstens added that there would be an investigation into how Treeby had been identified.

The inquest into Anika's murder began this week in the Pretoria North Magistrate's Court.

The court has heard details of vampire parties, blood shooters and the social pecking order among teens, among other things.
Eksteen's former husband Johan Smit has cut a lone figure throughout proceedings, sitting by himself on a bench in the sunny courtyard during breaks, clutching a brown folder.
It was he who came face to face with the terrible sight of his dead daughter on March 10 2010. Anika had stayed home from school that day because she had an ear infection. He found her with her throat slit and her hands chopped off and missing. She had been raped.
Her boyfriend at the time, Nico Venter, was initially charged in connection with her death and Johan Smit was also questioned at length.
The case against Venter was dropped and he and his wife have been in court throughout the inquest.
Venter has a legal representative who has been posing questions to witnesses.

Johannesburg - Slain teenager Anika Smit's father was both emotional and relieved on Monday after a 24-year-old man was charged with her murder, rape and mutilation.
Shortly after the matter was heard in the Pretoria North Magistrate's on Monday, Johan Smit told reporters through his lawyer Willem Koekemoer that it had been an emotional day for him.
"We are glad that someone has come forth and taken responsibility and from thereon we will follow the court case and we will see what happens with the criminal case from there," Koekemoer said.
Smit kept his eyes lowered and did not speak much during the duration of the court proceedings on Monday morning. He left quietly after his lawyer addressed the reporters.
Smit discovered his daughter in their Theresa Park home with her throat slit, her hands severed and a glass bottle sticking out from between her legs.
The teenager had stayed away from school with an ear infection on the day of her murder and appeared to have opened the door for her attacker.
Three "persons of interest" became central to the case, including her father.
Another was a friend of hers, Damian Treeby, who was dubbed "the vampire" for his name on messaging application Mxit as well as Smit's ex-boyfriend, Nico Venter.

However, at the weekend, Andreas Johannes van Wyk handed himself over to police for Anika's murder.
During his first appearance in court on Monday, the 24-year-old, dressed in a greyish-brown blazer with a short but well-built frame, stood obediently in the dock as Magistrate Pierre Wessels told him about his rights.
Van Wyk requested Legal Aid assistance and the matter was postponed to September 26 for a formal bail application. He is believed to have been Anika's schoolmate.
Both Venter and Treeby and their families joined a packed court gallery eagerly awaiting Van Wyk's appearance.
Venter was initially accused of killing her but the charges were withdrawn.
On Monday, Venter said he was surprised when he heard that someone had handed himself in.
"I'm glad he came forward. We’ll see what the developments are after this, hopefully now nobody that is innocent will be arrested [and] we can come bring this to a close."
Venter said he did not recognise Van Wyk but did not dispute that he may or may not have seen him once before.

The inquest previously heard revelations about schoolchildren drinking blood shooters at a vampire party and how Treeby became friends with a group of high school children that were interested in the occult. One of them was drawn to Satanism.
On Monday, Andreas Johannes van Wyk appeared in the Pretoria North Magistrate's Court on charges of murder, rape and mutilation of Smit six years ago.
Treeby, her ex-boyfriend Nico Venter and her father Johan Smit were all considered persons of interest in the matter.

"For the past six years I have been treated like a criminal. And I was found guilty by public opinion. I was labelled a Satanist and a murderer by several people including the media.”

The matter was postponed until October 25, while the State waited for a bed to open at Weskoppies Psychiatric Hospital.

Anika Smit accused to start psychiatric evaluation
Pretoria - The man accused of murdering teenager Anika Smit has been sent for psychiatric evaluation, the Pretoria North Magistrate’s Court heard on Tuesday.
André van Wyk, 26, known by his friends as "Smiley", made a brief appearance in court on Tuesday morning. He sat in the dock, dressed in the same grey suit, showing no emotion.
At his last court appearance, the State said it was waiting for a bed to become available at Weskoppies Psychiatric Hospital.
Prosecutor Tania Carstens said on Tuesday that the bed was ready and that he would be evaluated over 30 days.
Van Wyk's attorney, Corrie Nieuwenhuys, thanked the State.
"We are thankful that the bed was arranged so quickly. Normally these things take time," he said.
If his evaluation was completed before the 30-day period, he would spend the time until his next court appearance, on November 25, at Kgosi Mampuru prison.
He is facing charges of murder and rape. He handed himself to police in September.
Smit, 17, was raped and mutilated in her Theresa Park home in 2010. The Grade 11 pupil at Gerrit Maritz High School lived with her father Johan Smit at the time. On the day of her murder she stayed home from school because of an ear infection. She was raped, her throat was slit, and her hands were cut off. Her hands have still not been found.
Smit's boyfriend, Nico Venter was accused of killing her, but the charges were withdrawn. He previously said Van Wyk's arrest was a surprise.

Pretoria - The man accused of murdering teenager Anika Smit has been sent for psychiatric evaluation, the Pretoria North Magistrate’s Court heard on Tuesday.
André van Wyk, 26, known by his friends as "Smiley", made a brief appearance in court on Tuesday morning. He sat in the dock, dressed in the same grey suit, showing no emotion.
At his last court appearance, the State said it was waiting for a bed to become available at Weskoppies Psychiatric Hospital.
Prosecutor Tania Carstens said on Tuesday that the bed was ready and that he would be evaluated over 30 days.
Van Wyk's attorney, Corrie Nieuwenhuys, thanked the State.
"We are thankful that the bed was arranged so quickly. Normally these things take time," he said.
If his evaluation was completed before the 30-day period, he would spend the time until his next court appearance, on November 25, at Kgosi Mampuru prison.
He is facing charges of murder and rape. He handed himself to police in September.
Smit, 17, was raped and mutilated in her Theresa Park home in 2010. The Grade 11 pupil at Gerrit Maritz High School lived with her father Johan Smit at the time. On the day of her murder she stayed home from school because of an ear infection. She was raped, her throat was slit, and her hands were cut off. Her hands have still not been found.
Smit's boyfriend, Nico Venter was accused of killing her, but the charges were withdrawn. He previously said Van Wyk's arrest was a surprise.
