Hi,

I need to draw up one and need some advise on where to get it done in the CPT area.

What is the cost involved in gettting one drawn up ?

thank you

Do it online, it is usually a lot cheaper. I paid R950 in February.

Find a lawyer who does ANC's.

I did one through a lawyer in January and it cost me R1000 on the dot.

She did everything and there was no hassle for me.

PS. I did it in JHB not CPT so unfortunately can't help out with a contact down there.

Please make sure all names on the contract are 100% correct. We did not and just discovered after 6 years of marriage that they got my wife's name wrong. Her name is Anne-Marie and it was captured as Anna Marie.

To explain the implications: We cannot register our new house deed in both our names, it has to be done in mine. If we get divorced or want to alter the contract, we first have to get this amended and this could cost up to R20K.

Even though her ID no (presumably) appears correctly in the ANC?

Why doesnt she go to home affairs and change her first name to Anna Marie? Cost is R140.

Mine was R1200, lawyers in CPT charge all sorts of crazy and I even got a quote for R5k haha.

I used Roelien Roodt in Brackenfell.

It is a clear case of misspelling. If the ID is linked to the name and there is just a slight misspelling of the name, it is obviously an honest mistake.

We need to get the original ANC and then submit it to the deeds office for correction. If the deeds office reject it, then we need to go to court.

why do people get married with ANC contract? unless you have a business worth millions what's the point. when you get married things should be shared equally.

That could break everything else that is in her correct name.

I can't see how it would invalidate any contracts that were previously entered into. I mean if a woman changes her name after she gets married, as she should :p, then that doesn't affect anything, does it?

LOL, classic post bwana. Post of the year i reckon, so random but damn it would save money and time :D.

It would mean that at each and every place where she contracted or where she does business, she would have to change her name too.

And some people's names carry some significance to them, so they would be loathe to change it.

Ok. Why didn't my wife have to do that when she took my name?

For a great many reasons other than that.

Especially if you enter the marriage with some assets of your own you would be really stupid to "gamble" all of that on something that might not last.

Things can and should be shared as of the time that the marriage commences, which is what an ANC with Accrual makes exceptionally easy.

If you are doing an ANC without Accrual...then ja...you might as well not bother getting married.
