Are Evetech allowed to do this?

On the EVETECH EFT Order form they state that you need to send a proof of payment in order to speed up the process. I made payment and phoned them as I wanted to collect and they told me that I had to wait for the funds to reflect in their account first. This was never stated on the order form but is stated on the Terms of Service (among some other stuff that I disagree with)

I'm irritated with them but there is one part of the Terms of Service that I dislike and want to know if it's even legal:

Data Protection

10.1 The Supplier will take all reasonable precautions to keep the details of your order and payment secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.

I know this is a little off-topic to hardware but I thought you might be interested in the read.
 
Yes, It's a reasonable step. Why should they be liable if a hacker breaks in and steals all the info despite them taking reasonable steps.
They have excluded negligence, so if it IS their fault, they will be liable.
It's a very fair statement.

No problem. We have a similar policy with EFT clearance as well. If they send us the Proof of payment, we usually clear it immediately.
But if it is a cheque payment, we wait 7 days.
 
Nothing wrong with that ... what I find odd is that you got irritated because they did not want to release the products to your before your payment cleared? That is unreasonable of you in my opinion.
 
General comment .... Evetech are great. Spent a wad of cash with them, and never had any issues with returns, deliveries and the like ..... just saying.

It's more a case of me paying from two separate bank accounts (one FNB and one Absa) and my FNB one clearing and my Absa one not clearing and they were pretty rude to me about wanting to collect both before the Absa one cleared.

Hardware vendors have to deal with people trying to defraud them on a daily basis, so don't take it personally.

Are you aware that there is exactly a scam like this doing the rounds where someone would claim to have paid in an amount and sent through the proof of payment, but then the funds never clear and by the time the vendor realizes this they already made off with the goods?

In our case, we only clear the order immediately when we can verify the proof of payment on receiving it via email. Lately we have expanded the system to include other payment gateways to support EFT in this regard, as we know that the payment is secured on the immediate transaction. In my personal capacity it is best to secure payment directly to your bank, it is only that theft in the digital playground is a reality.
