Attorney for Telecoms

Aren't those contracts kind of iron clad?
What would be your argument for wanting to get out of it?
 
I am having a dispute with them over my billing, for the last 3 months my bill has increased by R1500-00 extra to bring the bill to R3k.
I have not been speaking more but they say I have used more time on the network. I just dont understand how this is possible.
I have had a contract with Vodacom / MTN since 1995 and have never had a bill over R1500-00 approx.
Now once again they cut me off this morning as I went over my "limit".
I am at the point where I want to stop paying, they can blacklist me.
I spoke to a call centre supervisor who told me they are having massive billing issues but now MTN is going back on this.

This has got to be the worst company I have ever dealt with.
 
FFS had they not sorted out their billing issues a few months ago? :erm:

You'll really have to scrutinize your statements and then try and go ahead - or wait for them to sort out their billing issues.
But then again - it's them inconveniencing you...

You don't really need a telecoms lawyer. You probably want to find a good consumer protection lawyer.
 
IMHO billing issues and incorrect data usage on the SP's part should also be a valid reason for terminating a contract from the customer's side, without the customer having to incur any penalties.
 
I have been down this road. You need to get reference numbers and details of the people you speak to in the call centre. MTN has billing problems. Refer the matter to ICASA get a reference although I found them to be toothless. Then speak to the MTN admin in this forum to assist you. You can go to a website called getclosure.co.za. At this stage this is your best right of recourse and its all free.
 
Ahh but this is for voice and how does one prove it on mtn as they work on money used not minutes used

Get a prepaid SIM, inform world+dog of temporary number change.

Leave contract SIM with shark attorney. (with request for PIN enabled, and shark attorney doesn't have the PIN etc).

If data/voice usage still occur with unused contract SIM at shark attorney, then you might have a case.

But well, that's just a knee-jerk reaction.
 
If you are on a bundle contract, I would advise you to go over to SAINET. MTN's billing has been chaos since April LAST YEAR.
 
I believe you have recourse as the standard contract could be considered unfair under the National Consumer Affairs (Unfair Business Practices) Act, there could be both common law and equitable remedies available to you.
