Johannesburg - Basic Education Minister Angie Motshekga is reportedly contesting the view that "the right to a basic education is immediately realisable" due to what the minister calls “budgetary constraints”.

Motshekga has also backtracked on previous promises to publish norms and standards for school infrastructure, the Mail&Guardian reported on Friday.

The minister’s views are contained in her response to NGO Equal Education’s application to the Eastern Cape High Court to force her to publish norms and standards.

In its court bid, Equal Education argued that "the right to a basic education is immediately realisable and is not subject to progressive realisation in the light of available resources".

But in her response, Motshekga says "budgetary constraints" and "the limitation of available resources" cannot allow for the minimum norms and standards.

"[T]he right guaranteed by section 29(1)(a) of the Constitution is the right to a basic education [and] account has to be taken of socioeconomic realities," Motshekga states.

‘Children need education now’

But constitutional law expert Pierre de Vos told the M&G that the minister’s view was “perplexing”.

He said the Constitutional Court had already distinguished between education and other socioeconomic rights, such as housing and healthcare, by saying that "the right to education is not qualified by available resources and is not subject to progressive realisation".

"Children need to be provided with basic education now. It is not about waiting for money to do this," De Vos said.

In 2010, Motshekga promised that "norms and standards for the physical teaching and learning environment will be set at the national level by the department of basic education".

These would be "effective from [the] 2010-2011 financial year", her June 2010 policy document declared.

But according to her answering affidavit to the Eastern Cape High Court, Motshekga subsequently decided to adopt only "guidelines" after being "persuaded" by provincial education MECs to do so.
 
How can over R200b not be enough? Maybe they need to audit the DoE a bit.
 
I went into the Juta Books that is in the building I am currently sitting in. I had this thought of buying a book and sending it to a random school in Limpopo.

They want R275 for a maths text/workbook. It is possibly about 200 pages long and consists of A4 sized pages with lots of space to write in.

Which idiot came up with this idea?

Never mind the cost, which has to be a rip off.

Why do we have books in this format? Surely you get a text book and you do the exercises in an exercise book? You can see corruption all over this. Every year the people with the tender will print more. And at the prices they are charging they'll be rolling in the money.
 
This is balls, and Angie's little idea is precisely why she must be FIRED.. not redeployed, but fired outright.

This is why the norms and standards need to be defined. What is basic education? A, B, C? What about the rest of the alphabet?

When I was at school (and history books were thinner) we got a textbook that we signed for and handed back at the end of the year. If it was damaged we'd have to pay for it. But it could be reused.

And another thing that grinds about the books, I don't think they are printed in SA.

Also, my wife told me this morning that Grade 1 is now for 7 year olds?
Waste an entire year when the child should be learning the basics for what???

Unfortunately that stuff up came from that idiot Kader Asmal.

You can get your child in earlier (or as it should be).
 
You cant miss-appropriate funds for cadres, buy Benz'zzzss n Bmzzzzz, and school books at the same time. Really don't be silly.
 
The poor of this country are suffering and now they will suffer more.
 
Might be offensive to some but the ANC's just condemned another generation to being gardeners and maids. And then they talk about white privilege .. at least we make sure our kids are educated so they could have bright futures.

Same here, the first page was stamped for your name, signature and year. I remember often seeing at least 3 or 4 entries and it was always fun seeing the names of others you knew.

We were required to cover them in plastic as well and this was checked.

I started Sub A (grade 1) when I was 5 turning 6 in that same year.
 
Shocking news! Just goes goes to show how this country is really ***ed up!

Everything seemed okay on my way to work this morning. Stop being overboard and taking everything as "OMG this country is ffffffffffeeeddddd!!".

On another note, this whole thing is truly sad because the very same people voting the current government into power are the ones whose kids are suffering the most because of their incompetence and corruption.

The word 'stupidity' is redundant - it is a given - so that only leaves 'corruption' ... :)
 
Lets see .... Text book = R275 X 6 subjects R1590 ....

Just get a cheap Tablet, and distribute e-books. No delivery issues etc ..... Why not? Its green (saves paper) so +1 environment.


EDIT: Wait I forgot ... this is SA, no service delivery = no electricity to charge tablet (and even if there was, Escom would probably fail anyway) And Broadband is too expensive for the masses ... fail Telkom ... eish - pipe dream :(
