Pretoria - The murder trial of Blue Bulls rugby player "Bees" Roux has been delayed until Wednesday this week to finalise discussions between the State and defence.

Judge Nomonde Mngqibisa-Thusi postponed Roux's trial in the North Gauteng High Court in Pretoria on Monday and extended his bail of R100 000.

National Prosecuting Authority spokesperson Mthunzi Mhanga would not confirm that the discussions included a possible plea bargain agreement.

He said the discussions had been ongoing for some time, but could not be finalised in time.

"By Wednesday, we will have an indication of how the matter will be dealt with," he said.

Murder charge

A smartly dressed Roux was present in court, accompanied by his girlfriend. They were seen walking outside court hand-in-hand to a white bakkie parked not far from the exit.

Roux was charged with murder after allegedly beating metro police officer Sergeant Ntshimane Johannes Mogale, 38, to death in August last year.

The incident took place after Mogale pulled Roux over for allegedly driving under the influence of alcohol.

Roux said in an affidavit during his bail application he had assaulted Mogale while defending himself against theft and attempted robbery by Mogale. He indicated that he would plead not guilty to the murder charge.

A 29-year-old man was later arrested and appeared in the Pretoria Magistrate's Court in connection with charges of theft and fraud relating to Roux's credit card, which was reported missing from the scene.

The credit card was used to buy liquor, food and electrical appliances.

Sometimes it feels like forever before things start to happen.
This is going to be an interesting one
 
Prosecution would battle to make any case so they are going for culpable homicide - under the circumstances I'm surprised if they will even get those charges to stick.
 
I think it is. Bees says he will not plead guilty. What will they have him plead?

We discussed this last year and it's pretty straight forward.

They charged him with murder of which he is not guilty of. Unless they charge the charge to Manslaughter he will walk free. That being said, I assume this is what they are trying to iron out. I can see Bees making a plea bargain if given Manslaughter, but on Murder if I was him I would let it go to trail.

Anyway, who knows... We'll have to wait and see.
 
If he does get off, I'd like to find out who his lawyers were. Always useful if you find yourself with a dead body and blood on your hands.

That's why I’m saying this is going to get interesting. There is his story the witnesses story and the truth. We will see which one wins.

Well apparently the cop had numerous accusations against him prior to this incident, was not driving towards any police station and no blood tests were arranged - so there was definitely something very fishy going on.

No, just hope you are charged by the same people who charged Bees. His lawyers don't have that much work to do if they claim murder.
It's going to be near impossible to prove that he intended to kill the Metro cop by beating him.

That too. I do not think its as open and shut as people would like it to be.
 
To be famous and moneyed in this country = above the law & out of jail. An ordinary citizen would have spent all that postponement time rotting in a jail cell somewhere.
 
And just as hard to disprove self defense.

On a murder charge he doesn't even have to claim it was self defense. He just needs to prove that his assault on the officer was without the intent to kill.
Unless they have back-up charges he will walk a free man. If they change it to Manslaughter then yes we have a court case. But he'll plea then I'm sure. They charged him incorrectly to begin with.
