I agree that it is interpreted by laymen to be calendar days: Saturday and Sunday both end in "day". If they want to be consistent, they should claim that the 6 weeks should be 18 weeks because they only work 8 hours a day!is should be calendar... but they're saying working.
Sounds like fraud. A scam!I also was scammed when i placed an order for an item in stock...now 2 months later...no item received...was also informed of the 15 to 30 day wait period...i theatened them with criminal proceedings but they are hoesebacking on the electronics Act. I am sure this is fraud/theft what they are doing
The CPA does stipulate that interest must be payable on the money they have taken. It does not say which interest: prime/overdraft/credit. It does not provide for penalties for failing to repay on time either.Except that the section in question relates to return of goods.
In this case there are no goods.
They don't have it, they even admit as much.

No court would find for their interpretation that they can apply this to not having stock of said goods and then holding your money for 30 days (working or otherwise).

This must have been common knowledge amongst employees. They colluded by taking orders they knew they could not fill. They colluded in lying about delays. They colluded in delaying repayments. They colluded in breaking the ECTA and CPA. They (all employees) have proven themselves dishonest and untrustworthy. Beware.

What is the proper procedure to follow when an online retailer doesn't refund you?
I placed an order on the 1st with a biggish player - they charged my credit card the full price - contacted me and told me the price of some of the items has increased (20%) - I declined and requested a refund, which they said was processed on the 1st. (the items still reflect as in-stock at the original price on the site)
Well - no money - and I'm over sending them emails, they're not really interested, and respond with disinterest, trying to put the issue on my side - or ask me for information they have access to (i.e. the actual debit transaction).
My next step is unfortunately social media (and they had 5* ratings from me) - I'm not sure if a bank can assist with a partial charge back?
