Hi Gents

Some unknown individual started a blog on blogger/blogspot with the sole purpose of slandering a family member of mine. He is in a senior position at a company that has some very large corporate companies as clients. This garbage could potentially damage the relationship with the clients. The person sent a link to the blog using a gmail account. Without going into much more detail - I would like to know whether this person can somehow be traced?

If it's slander then you do have legal recourse, if this senior management company representative feels the need to defend himself. If you're able to track him/her down, what are you going to do about it? Send them a sternly worded letter?

Legal action will be taken but its just a matter of finding the person. I believe a request has already been put forward to google but who knows how long that will take.

Well uncover the details illegally and you might as well kiss your legal chances out of the window. Just let the legal process take its course. A take down notice would have been sent to google and that is enacted upon fairly quickly to the best of my knowledge - the identity of the individual will take longer and requires a court order iirc. If your lawyer is already dealing with it, then why go the route of tracing the person on your own? Seems a duplication of efforts that might inhibit your ability to take matters further from a civil perspective...

He sent a request to google on Thursday and has received a reference. Would you recommend that he gets the lawyer to just handle everything?

He has 2 choices - either handle it himself, or go the legal route. Seeing as he's chosen the legal route already, and I'm going to assume he isn't legally trained, best leave it to the lawyers to deal with. What would be the point in interfering?

The legal route is the best one to take here. Even if it takes time. All too often we want to rectify matters and often it is at the detriment of a legal case.
You family member should be open with his clients about it though and have a reply worded with the assistance of their (family member's) legal representative that they can use as needed.
The big corporate companies are more likely to support your family member because they have an existing relationship while what is out in the blog space although not nice is just hearsay.
Also if they raise the Corporate's awareness as to what is happening and outlining in VERY broad detail what they are doing to prevent the comments will show your family member to be a person of integrity and honesty and (if you know the term) move them closer to being a trusted adviser.

Its actually very easy to get the South African IP of this person... with a little social engineering :D

PM if you would like an easy way to get this persons local details :D
