Cape Town - It is now illegal for police officers to randomly stop and search people or enter any premises looking for drugs, unless they have a search warrant.

And if they do, they would be in breach of a recent Constitutional Court judgment aimed at preserving citizens’ right to privacy.

This is great. Got stopped and searched a few times in my early twenties. Having to lie face down while your car is being searched is embarrassing

This is the best news to every have happened in SA!!!

I am not going to lie. I have a number of people selling to schools in locations for me. Business is hurting when police stop and search my sellers. This will put an end to this. Business should be picking up for me and the children should now be able to get merc much easier.

Totally agreed. No single person in this country, police or not, should ever be allowed to act, in any manner, on reasonable suspicion. It should be stopped with immediate effect.

I also strongly feel that one single magistrate must not allow a warrant on reasonable suspicion. Once the warrant is approved, the matter must go to the High Court where a full bench of judges must decide on the merits. If they approve the matter must go to the Supreme Court of Appeals where a full bench must review the lower and higher courts' finding. Once they approve, the matter must go to the Constitutional Court where a full bench of judges should review all processes and application. Only if a search and seizure warrant pass here should the police be allowed to act.
