Boundary Wall

Hi guys

My boundary wall was collapsing for two years. For two years, I tried to get my neighbour to fix the wall, offering to share the cost. He was really difficult about it, threatening to sue me if I did anything to the wall. Eventually, I got the Council to give him notice. The wall eventually collapsed! He erected a new wall. I refused to pay for half of that wall, since the Council had instructed him to replace the wall. However, not wanting to be like him, I offered to pay for half the cost of a precast wall (which is much cheaper - I did not see the need for an expensive mortar/brick wall). He led me on to believe that he is happy with that arrangement, but after the wall was erected, told me that he refuses to plaster on my side.

I suspect the builder was part of the deception, as everytime I asked when he's coming to my side, he sidestepped the question.

My question is, since the wall collapsed, and he is responsible for erecting the new wall, is he obliged legally to plaster my side as well, or is it enough to only erect the wall itself?

Thanks

Jirre, really? :D

Just get a few bags of cement, building sand and a day labourer to plaster it. He's by no means obliged to plaster your side of the wall.

So have you already paid the half for the wall upfront? If not use that money to plaster the wall. To be honest with you the neighbour sounds like a proper knob, if he needs to rebuild a wall due to his own stupidity then by no means enable his behaviour by contributing half, let him suffer the full consequences of his actions.
