Bread Distributor's appeal upheld

The Constitutional Court has upheld an appeal for bread distributors who suffered financial losses in the Western Cape to bring a class action against three bread producers, the Business Day reported on Thursday.

The bread producers were Pioneer Foods, Tiger Consumer Brands and Premier Foods Limited.

The newspaper reported that bread distributor Imraan Mukaddam and others suffered financial losses because of cartel activity in 2006.

The three companies were reportedly implicated in the cartel, which was found guilty of anti-competitive behaviour.

According to Business Day, Mukaddam and other bread distributors in the province approached the high court last year for permission to bring a class action against the companies. The high court refused.

Mukaddam's appeal to the Supreme Court of Appeal was also unsuccessful.

He then reportedly went to the Constitutional Court, where his application for certification of the class action was upheld.

Business Day reported that Mukaddam was granted leave to supplement his papers within two months of the order, setting out his claim against the three producers.
