Buying a Device from Gumtree

So this is the time for me to say bye to a iPhone 6. I'm wating to buy a iPhone XR and i saw one on gumtree for 10k. The problem I'm sitting with is the device is on contract and they do have papers. I'm just scared they don't pay their bill and the device gets blacklisted. Will it be possible to setup an agreement stating that if the seller does not make the payment each month and the device gets blacklisted that i can take lawful action.

No, unfortunately that's a risk you take with buying a device that way. It's honestly not worth the risk.
 
Even if you were able to get an agreement in place, you will still come out second best if things go wrong..

Move along and find a phone that's debt free..
 
1. The process is too high for taking such a risk. Invest some more and buy a new one.
2. If u are able to negotiate a good price, also check the owners credit score, it cost around r80 on the Experian or Equifax website. If the person has a good credit history he is most likely going to pay up their bills on time.
3. If u buy the phone anyway and if it gets blacklisted, I will be happy to buy it from u for spares

change of ownership means he will have to pay the monthly bills until the contract is over. If Op wanted that he can simply get a new phone on contract.

You can take the money that you suppose to pay the buyer and pay the contract for remaining months then pay the buyer with the remaining amount.

No.. the xr was available from end October last year in SA.. IF the seller got the phone in October, that means 13 months left, assuming a 24 month contract.. Then assuming it's with Vodacom on the cheapest contract, 749 a month.. that 10k covers the remaining 13 months..

This is a bad idea for the OP, no matter which you swing it..
