We would like to purchase the house that we have been renting and have agreed on a price with the owner. What do we need to do effect the sale if we do not want to involve an agent?

I dont want to miss any details and pay a bond only to find the house is not registered to me at the deeds office for instance.

You'll have to get a transferring attorney (conveyencer) involved. This should ensure that all documentation is completed properly. The bank will appoint their own attorneys in any case to handle the bond transaction from their side

All you need to do is complete an Offer to Purchase with the current owner and attorneys will handle the rest (they should be able to provide you with a generic version). Obviously there's a cost involved, some of which is negotiable, some of which is government legislated

I can refer you to a brilliant conveyencer who won't rip you off if you like, but I'd suggest you shop around a bit first as well. Remember the seller is entitled to appoint the transfering attorney although you'll be the one paying the fees

[edit - I think Private Property might have a free OTP download on their site]

You need an offer to purchase, I am sure you can find one on the net. Then you need a conveyancing attorney to do the transfer. This will cost you a couple of grand, he will make sure everything is in order and transfer the house to your name. He can most probably also do your bond registration, just make sure the attorney is on the bank's register. Whichever bank you use can also suggest an attorney for you.

also if you haven't already sorted your bond, consider using an originator - takes all the hassle out of the run-around the banks will give you and won't cost you a cent

Does anyone like being ripped off? (Sorry couldn't resist) :D

Thanks guys.

Bond is sorted, and I was just worried about the details. I used to date an attorney, I wonder if she will do it for free. :D

sex would probably be for free, but attorneys never do free work

If you instruct her to do the work, she will definitely screw you, but not in the way you may think :D
