Can I get a refund on graphics cards?

Hi guys,
I bought 2 Gigabyte R9 280X graphics cards in January/February, the two I got showed some artifacts and screen jumping so I sent them back. They were replaced with 2 new identical cards. The cards have now started showing the same issues. I tested both in two different PCs and the same issues stay. I have also tested other high end graphics cards in these PCs and they were fine so it's definitely the graphics cards. I now want to buy other graphics cards as I no longer trust these. I read in the CPA that consumers have the option in the first 6 months to repair, replace or replace items that are defective. Can I legally insist on a refund?
 
Yes, if the item is still under warranty, you are entitled to :

-Have the product repaired or replaced
-Be fully refunded

Did you test the cards individually? May be a crossfire fault? Did you try to underclock them?

Where did you buy them from btw?

Your problem is Gigabyte go for Asus or MSI and you wont get the issue.

I'll PM you. Tested them individually. Problem occurs at idle too so I think it's just bad manufacturing from Gigabyte.

Your problem is Gigabyte go for Asus or MSI and you wont get the issue.

Looking to go MSI or EVGA and nVidia

I don't mind shipping them, so I am definitely entitled to a refund? Is this my choice or can they force a replacement on me?
 
CPA says it's your choice within six months of original purchase or 3 months of repair/replacement if faulty again

CPA says lots of things, good luck trying to force the supplier to listen.
It took me 2 years of battling before I got a replacement card.

Seconded. Even though the CPA has been around for some time now, many suppliers and consumers still aren't fully aware of their rights and responsibilities. And the National Consumer Commission, tasked with implementing the Act, has largely done so with disappointing incompetence.

If a supplier refuses to listen, then you can enforce your rights by approaching the NCC or the National Consumer Tribunal - but don't expect a swift resolution. I have seen favourable consumer judgments, but it can take years before they are rendered.
