Cancellation a day after telephonic agreement

Hi all,

I agreed to a Cell C Epic 150 contract on the phone earlier today , faxed 3 months banks statements, ID and payslip though to them and thought all was well. Turns out that after discussing it with my friends and family they've been telling me what a bad choice of network Cell C is and that the Epic deals are really difficult to work with. The device as well as the terms and conditions will be couriered to me in the week, I have not physically signed anything yet.

Is it too late to call in and cancel the agreement? Or am I bound from 24 months from this point onward? Can I just refuse to accept delivery of the device as well as the paperwork? I've heard there's some sort of 20 day cooling off period that allows me to cancel such an agreement, does this cooling period really exist?

You may be able to invoke the cooling-off clause if they called you, and you did not request contact.

Thanks for the responses. I have not been able to cancel the application this weekend, the call center staff say that I need to speak specifically to the lady that handled my application and she works from Monday to Friday only. I'll be calling again tomorrow to try to cancel.

Isn't the contract only active after I supply RICA documentation? I have not given them proof of address as yet, the courier would need to pick that up from me when he arrives, therefore isn't it possible that the contract would not be running yet ? If I simply refuse to accept the device, refuse to sign his paperwork and refuse to supply RICA documentation wouldn't they cancel my contract application?

Unless there's a specified cool off period they could still be douches and force you to honor the deal you agreed to. Or force you pay a cancellation penalty.

Called and cancelled today. They were actually really polite and prompt about the whole thing. Hats off to them for not being douches about it. I'm impressed Cell C.
