Looks like I'm stuck with this.Phoned Nowire a few minutes ago and was told since I haven't completed the 24 months , I cant bail out.The guy told me that I will end up paying a huge cancellation fee.

It's not that bad. From what I understand, contract clients still get their allocated bandwidth. The only thing that changes is that you get nailed if you exceed your cap. On MyWi 256, you'll still get 20GB at a decent price. There aren't many options out there where you can get that kind of cap at higher than 64kbps for less than R1000.00 p/m.
 
If you're still in your 24 months, you still have the classic cap till the end of your term. Unfortunately you'll still have to deal with their poor, slow, badly run service.

You know, if your contract doesn't mention a cap...I'd tell them to stuff it.

They can't charge you for anything that's not in the contract. They have to cancel the contract to do that.

So, if there's no 50c per mb in the contract...toughies for them.

Thats all very nice... maybe in Utopia. In reality, their skimpy little contract is obviously designed full of loopholes, by a team of lawers. For instance, the cap. In the contract it states nothing about any cap, however it does state that you must abide by their 'acceptable usage policy'. Now they can obviously chop and change the 'acceptable usage policy' as much as they desire, at any given time. They have done it just now to screw the MyWireless Classic people, and if you want to cancel the contract, it states that you will have to cough up the remaining amount of the contract period plus any (undisclosed...) costs, like their admin fees.
So tell me, how will you actually tell them to 'stuff it'?
 
also read the part where they can change anything on the contract without prior notification which binds you to it in any case.

I am no lawyer, but I am fairly certain that you can't merely have a contract referencing another contract that isn't easily accessible at the time of signing with full details of how to access it in the contract you're signing. I mean - imagine if they change their AUP to include things like "Must sacrifice first born"?

Also, you can get out of a contract by merely claiming you didn't understand it. So really.

South African Contract law is also about intent. Clearly in contracting to Sentech you intended to cap your costs. They can't change your intent. A judge would find them in breach.
