Car accident with pedestrian

Hi All

I'm looking for some advice.
On Monday I was involved in an accident with a pedestrian who ran across the road. SAPS is refusing to open up a case (which I need for insurance), insisting that they need the pedestrian's medical report which the pedestrian's family is refusing to provide.

What are my options here?

I was involved in a car accident recently that involved about 5 cars, I was the pedestrian hit by the said cars - although the damage to the cars was minimal like broken mirrors, broken bumpers etc, I still haven't had a case brought against me - I was taken to the hospital and that was that. Going to be interesting how the RAF claim procedure goes.

I assume the other drivers just opened the cases on their own. Did they have your contact details etc.?

Exactly... this seems more like an attitude problem than anything else.
Can I go to another police station instead of the nearest one?

BS.

I was in an accident 3 weeks ago where a cyclist was in the wrong. Saps asked no info from other party.

Go back and hope to get another officer.

And report to insurers with the details you have. Your insurer's would get all the TP info and reports if they need to defend the TP approach if there is one.
 
Yah always get all the paper work filed, reported etc. if the pedestrian dies or lodged a case to recover medical costs etc after and you didn’t.. bad things happen.

Like I said, a man escorted by the police dropped me at the hospital and that was that. Will try getting an accident report from them but the process will be complicated as the accident happened in a different province to the one I'm currently in - apparently I have to call the police in the province where the accident happened then pay a fee then they'll send it to the police station in the province I'm in. But last time I checked with the lawyers I'm claiming the RAF with, they already got the medical files from the hospital.

The first thing SAPS did when I reported my accident is they want to know exactly where it happened. They will literally measure out millimeters to claim the accident doesn't fall under their jurisdiction (presumably so they are not stuck with the paperwork)

I went to Kempton SAPS, they sent me to Boksburg SAPS, Boksburg SAPS sent me to Boksburg North SAPS. By the time I arrived at Boksburg north Saps they wanted to start the game over, if it want for the fact that I already visited the other two SAPS....
 
Try reporting the accident online?

5. Crashes which include a person or persons being injured, killed or involved in a hit and run accident/crash must be reported immediately to the nearest Municipal/Metro Police, Traffic Department (MMT) office or South African Police Service (SAPS) station.​

Never been an issue where I’ve reported.

They do sometimes just forward it on to the closest one where the accident took place.

But then I’m from Cape Town where **** actually works.
 
Go to another station. Last time I had a bumper bashing it took two hours of my day to find a station that would help. Had to be polite and apologise for waking them up. :laugh:

Insurance companies should take this over and lessen the burden on our cop shops. It’s the right thing to do.
 
Thanks everyone for their input.
I'm finally sorted out. The officer that assisted apologized and completed the accident report. I got a AR number and OB number, which insurance is happy with.

Apparently, when you arrive at the station, you must request an AR number and not a case number. :rolleyes:
