Car Purchased breaking down

On the 5th of January 2012 I bought a second hand car from a independant dealership in Pretoria. As per the dealership owner the car has had some repair done to it and had no mechanical faults to it nor has it been in a big accident that could damage it's chassis and he also confirmed it's not a code 3 car

Did you get this in writing? If so you might be able to take some sort of legal action to have the car replaced, but I'm no lawyer so I can't say for sure.
 
Similar thing happened to me this past weekend:

Flew up to JHB on Friday to take delivery of a Saab convertible from Suzuki Bryanston. Picked up the car on Saturday morning. Went to brunch with friends and then the car would not start - not a good way to start a 1400km road trip back to CTN.

After numerous phone calls to the dealer and the workshop manager, eventually I had to disconnect & reconnect the battery before the car would start again. So back to the dealership where I left the car for them to sort out and get to me. So it looks like whatever electronic fault they had on the car and tried to fix is still not fixed.

My mates who helped me out told me to cancel the deal right away. Called the bank this morning and a few phone calls later to the finance marketer and the dealership, deal is cancelled. I was lucky though, the bank had not yet paid the dealer, so they put a block on the payment. Dealer had no choice but to agree. If they had been paid already it could have turned out differently.

Take your car back NOW and demand a full refund and inform the bank of what happened.
 
Just called the bank. They said the dealership has already been payed...:(

hmmm do they usually pay so quick, i wouldnt have thought so.

also there must still be a way, i would down right refuse to keep that car, you will still be covered under the CPA anyway.
 
If the vehicle was marked as a Non-Runner.. then I would assume its a Code 3 rebuild... you can check with the Motor Licensing Bereau...

But take it back.....

I've been down this road before, and thankfully the dealership I bought from was loosely affiliated to McCarthy's so when I got them involved I got results quickly.
 
2nd hand car dealers are such a-holes! Guess one has to be careful to use one of the big box retailers when buying a car. This small ones even when affililiated to industry bodies just can't help but try to screw over the innocent buyer.

You got to try and get the deal cancelled... the ombudsman is not always helpful as it appears to be a voluntary good faith thing. The dealer can safely tell the ombuds to f-off.

I will be phoning the bereau in the next 10 minutes. Hopefully they can help.

If it's a code 3 rebuild, they are stuffed. It clearly states on the IDA website, they will never sell a code 3 vehicle.

technically it cant be a code 3 as you say you financed it which means it has to be insured and insurance wont insure a code 3 to my knowledge? so immediately your insurance should have told you

But can't unscrupulous dealers register code 3s as regular second hands? They showed that Landy on carte blanche where the car had been split in two, but rebuilt and sold as normal second hand. The OP should try and track down the previous owner.

but then surely it was never registered as code 3 thus hard to prove?

Tried to get the information of the previous driver from Audi Northcliff and Audi SA and they refuse to give it to me. Which I can understand, but how will I get the information then and make contact with the previous owner.

you have checked the service manual?
