Hey Guys,

Just want to find out. When registering a CC would you do it yourself or get a company to do it for you? If so can you recommend any companies?

If you know a registered bookkeeper do it yourself. If not get someone to do it.
 
You will need an accountant to get your accounts audited. Get your accountant to register the CC.
 
you need a registered accountant to do this as cipro needs to know the accountants registered practice number. so, no sorry, you won't be able to register this yourself.

Also be very careful of shelved CC's: Government issued another warning last week about them. One of the problems is government is closing down dormant CCs and some people buy shelved ones only to discover they are being closed down.

Also the case-law* on CCs has changed so much that there is no longer benefits to having one. My wife has a CC and she is going to start the process of dissolving hers in the next few months after consulting her partner and auditor - ex SARS.

*Important case-law was that CC members can now be held liable for debt. Defeats the object of a CC.
 
I know off the shelf is pointless, soon the t/a trading as will be illegal.

where do you get that information from? it is perfectly legal and there has been no indication from anywhere to say it isn't legal. SARS will be the first to announce something that is illegal. so you can quite safely trade as. so whoever told you this tell them to get their facts straight.
 
Since the new companies act came into action the registration of cc's is no longer allowed from what i understand(continution is fine), the whole purpose of the new companies act was to simplfy things so that setting up a company will be "easier" but it will also be complex if it needs be, this is what ive learnt in company law at least. Its ment to come into play from the end of march from what i remember, i will have a look at my law text books a bit later on :)

Your linking a shelf cc company. I also understood from my wifes auditor that no new CC's. But the problem I currently have is very little reliable information so I'm poking around where I can. So far all I'm certain about is that CC is no longer the way to go. In a couple of years they will be obsolete. But how many years is a couple I do not know.

We just renewed 3 CC's, so I seriously doubt it's going to fall away. That said, the rumor about CC's falling away has been around for probably 6 years now? I'm planning on registering another one soon, depending on the business nature, and my partner's interest in it. Shelf Company Warehouse can convert existing CC's (i.e. shelf companies), or register new ones. And I know our accountant still registers them as well, but she's more expensive
 
You can't register a "new" cc since the new Companies Act.
You can however purchase a registered, dormant cc (which is what Shelf-Company Warehouse do since the act came into effect.)
They registered a whole bunch of cc's before the cut-off. When you register a "new" cc with them you are just affecting a name change and a change of ownership of an existing cc.
But their service is excellent, quick and reliable.

So what is the best way to go for someone who is like me a sole proprietor who needs to be a little more officially organised?
 
i'm in the same position - i'm getting a shelf cc registered.
boy is it taking forever.
i heard that for sole props, cc's are still a good option.
 
Yep...no new CC's will be registered. The new Companies Act is also not yet effective...until the President signs it. It will then replace the old Companies Act. The new Companies Act does not make provision for CC's. There's different forms of companies now. Therefore the decision not to register new CC's.

Its still not clear if current CC's will continue to exist or if they will be forced to convert to another form of business as per the new Companies Act.

So a shelf CC would be the only way to go now.

You can no longer register new CC's in any case since a couple months ago.

Hi, I registered my CC in June 2010 with a company called BDF Registrations. They offer instant SMS updates on the whole process and registered my CC within 8 days. Their services are great! The CC Registration costed me R299.
