Cell C Blackberry Bold 9780 Problems

A Friend of mine has been having countless issues with her Blackberry Bold 9780 on Cell C Top Up 225 Contract..
Have sent it in twice the last couple of months for the screen just deciding to not work or display incorrectly, with a waiting time of 5 months between cell c losing the phone between they're repair center and outlets and each time after 2 months the exact same problem happens.
Same thing happened again and being quite fed up with them eventually returning a refurbished/repaired phone and for it to break again in two months time.
The representatives at some of the Cell C stores in pretoria suggested that we "lose" the phone and they would blacklist and claim from Cell C insurance. Then we will get a brand new Blackberry Bold 9790 within a week's time...
The one guy also mentioned that should we send the Phone in again for the umpteenth time that it would be flagged and there could be some "issues" which would take even longer to replace the phone..

This just doesn't sound right to me :confused:
..
Isn't the RIM - Blackberry policy that they should replace it with a new one in the 1st place under the Manufacturer Warranty ?
...
It would also suggest that they seem to have flagged the previous cases as Failure under User Abuse instead where there isn't any the phone is in almost brand new condition, besides for the screen that goes haywire with no physical damage to it...
