Paris - France's competition authority on Thursday slapped record fines on the country's three mobile operators SFR, Bouygues and Orange for illegally colluding on prices.

The Competition Council fined the three French operators €534m ($628m) after an investigation found they regularly shared "precise and confidential" commercial data between 1997 and 2003 - and even agreed to freeze their market shares to reduce competitive pressure on prices.

The watchdog said the market-share agreement, struck in 2000, "led to an increase in prices" as well as consumer-unfriendly policies such as the rounding-up of call times for billing purposes.

The fines against the operators are the biggest ever imposed by the French antitrust authority.

The largest penalty was imposed against France Telecom SA's Orange, which was ordered to pay €256m ($301m). SFR, a unit of Vivendi Universal SA, was fined €220m ($259m) and the mobile phone arm of Bouygues SA €58m ($68m).

Orange denied involvement in price-fixing and vowed to appeal the decision in a statement released soon after the fines were announced.

"Orange France contests this unfounded and gravely disproportionate sanction against the mobile phone sector in France," the company said.

I was going to reply with a quip. :D

I think The South African Competitions Board can take note as well.
ICASA however should be aware that the "Tri-opoly" situation we have here in South Africa with Vodacom, MTN and Cell C, is similar to France and perhaps send one of their people over to learn from the French.
 
$600 million dollars - pah. Think about the profits generated by this anti-competitive behaviour.

A bit like SARS fining me R100 for tax evasion, but not demanding the back-taxes.
 
Our telecoms providers laugh at the competition board. Telkom had, or was to be a fined once 10% of its turnover, dont think anything ever happened about it.

Below are extracts from Telkom’s 2005 Form 20-F:

The Competition Commission found, among other things, that several aspects of Telkom’s conduct prima facie contravened the Competition Act, 89 of 1998 and referred certain of the complaints to the Competition Tribunal for adjudication. The complaints deal with Telkom’s alleged refusal to provide telecommunications facilities to certain VANS providers to construct their networks, refusal to lease access facilities to VANS providers, provision of bundled and cross subsidized competitive services with monopoly services, discriminatory pricing with regard to leased line services and alleged refusal to peer with certain VANS providers. Telkom has brought an application in the South African High Court challenging the Competition Tribunal’s jurisdiction to adjudicate this matter.

These matters and the amount of Telkom’s liability are expected to be finalized within the next year. If these complaints are upheld, however, Telkom could be required to cease these practices and fined an amount of up to 10% of Telkom’s annual turnover or be ordered to divest itself of the relevant business. Telkom is currently unable to predict the amount that it may eventually be required to pay. If Telkom is required to cease these practices, divest itself of the relevant business or pay significant fines, Telkom’s business and financial condition could be materially adversely affected and its revenue and net profit could decline.

Telkom has brought an application in the South African High Court challenging the Competition Tribunal’s jurisdiction to adjudicate this matter. These matters and the amount of Telkom’s liability are expected to be finalized within the next year.
