Class Action Suite

It's not our fault? I thought you were trying to cancel?

Send a fax saying "Termination of iBurst" ... send it, phone the receoptionist and ask if the fax has been received. Keep a copy of the transmission slip. After 30 days, reverse the stop orders or cancel them. the Month2Month is not a contract, it merely states 30 days notice is required. OR, you can go to a lawyer and ask them to write a letter on your behalf.

But there are allways 3 sides to a story... Your side, iBurst side and then the REAL story. Why wont they respond to you? .. As I feel that this story is alot deeper and complex than its being protrayed here.

Afaik "US style class action suit" does not exist in our legal system.

south african law recognises may plaintiffs joining suit, it saves time and costs.

Relevance?

The case was argued in the constitutional court ... the issue was i.r.o their "right to safety and security" in the Bill of Rights while making use of metrorail facilities which our constitution does allow for in Section 38.

Note that they did not seek any monetary relief or damages but simply a court order to force Metrorail to perform their functions according to the Bill of Rights.

A slow broadband connection simply does not fall under the Bill of Rights or is a matter for the constitutional court :).

this is a common misconception! Since when does the constitution have horizontal application? The state has the duty to act within the boundries of the constitution, not individuals and companies. The consititution only ensures government compliance because the government is powerfull and people aren't so it helps correct the imbalance.

Thus Iburst or telkom is not bound by the constitution. They don't have to act consitutionally and niether to you!

Instead of going for a lawsuit against iBurst, might I suggest a lawsuit against your school? They obviously did an awful job.

i agree.

I also have issues with iBurst and as much as their support does suck they have NEVER told me it is my problem. Once you get through to a second level support suddenly things change and you're dealing with someone who wants to help you resolve your problem.

My problems are not resolved but their second level support gave me a glimmer of hope to stick with the service.

1st level iburst support is not the best, but try go to second level. Dont bother emailing... it's a waste of time.

While the breath of horizontal application may be a common misconception, it does have horizontal application according to section 8(2) of the Constitution. This is re-inforced by the FAQ on the Constitutional Court web site.

Good to hear that your problem was sorted out.

I.M.O iBurst 1st level support only deals with "minor" querries,
Username & Password, e-mail setup, installation and they issue tickets for 2nd level support to attend to it.

Not sure if they [iburst Helpdesk] have improved on troublshooting iBurst connection if a client have a office/home LAN.

I mean if they cant solve the problem telephonically logically they have to log a call/ticket for the subscriber and 2nd level/reseller will have to go out.

Not sure if what happens if your outside Gauteng, who do they send out if your in DBN/CT.

thnx native. <deleted by="ic" reason="personal attack"/>. I have phone iburst and on the 1 occasion i got to speak to someone with sense i got told that iburst second level technical will phone me on monday or tuesday to shoot through my issue. that was over a month ago and still no reply.
wat can i say they hate me i hate them

Dagga_bunny,
it seems that you are too emotional, calm down
get your facts straight
every correspondence with iBurst, and Broadband express should have been noted.
If it is true what you are saying, then fax all your queries, and reference numbers of to the head of iBurst

dude you pay 4000 for to install 24/7 56k speeds and R700 pm upon that nad tell me i must get pissed off

why did you pay 4g's for a modem that costs R2000, is broadband express taking the @ss end out of the market. These iBurst resellers remind me of the car towing companies, they are like vultures, trying to pick up all the scraps.
Reading these posts, it makes me squirm in anger, everyday there is another clown of a resller making an @ass of himself by trying a different approach on selling the same product, eg Fantastic1, poeple like these should be band from the forum.

Dagga_bunny, you should demand your R4000 back form Broadband Express, and if he does not return him send a fax to iBurst to revoke his reseller statis for poor cutomer support, and for ripping you off

No theres is nothing wrng with broadband express's charges, they did my Iburst install as well.
The modem cost you R2800 since Iburst stared and the price only chaged very recently, you cant quote the price as R2000. Its R2200 now btw.
Plus he has a aerial, which cost R650 back then, install costs which are okay at R250 with an aerial and router setup and then he is includng a router and wireless card costs. Nothing wrong with the set up price.

Have you ever tried the "edit" button. And punctuation? And capital letters? And a spell checker? You are unintelligible here most of the time. In the above string of words (I can't call it a sentence) you are saying exactly the opposite of what you are trying to say. Read over your posts carefully before posting. Review them after you have posted them. I'm sure you are much brighter than you come across. Have some pride.

Actually junior, Gatecrasher there has come up with the most polite of all possible responses to the vitriolic drivel you've spewed all over the forum in TWO separate threads whining and puling about your sorry plight.

Personally I don't think you're worthy of the effort, but he's rather more charitable than I am. That said, and tabling for now the apparent issue of your problems, the way you've handled this, and presented yourself is little better than a spoilt 5-year old brat. You've done VERY little to ingratiate yourself to a community that's actually pretty damn tight and willing to put in their time for free to help out.

Seriously: grow up, clean up and please, for the sake of the sanity learn to use correct grammar and punctuation ..you'd be amazed at how much more positively you'll be received, both here and in your communications with itBust
