CoCT considering challenging implementation of Aarto Act

The Administrative Adjudication of Road Traffic Offences (Aarto) Act will bring changes to driving laws, including a new demerit system and is due to come into effect on 1 July.

CAPE TOWN - There are a number of concerns about the new Aarto Act, which is due to come into effect on 1 July.
 
A giant gaping hole in the system is that those without a driving license won't suffer anything, and those with a fake/fraudulently-obtained license won't suffer much at all.

Totally agree, this is too huge to implement right now.

You mean their demerit points won't be docked as they have no license/fake license. But those ones probably get away with offering bribes so there is gaping hole already. Do you want to implement laws only when bribes are completely eliminated ?

Well duh.. have you seen the shenigans used with the existing system and “innocent” aka guilty as **** people stall the system.

Honestly I don’t see the issue and really wonder who’s the okes calling for this to be delayed and what palms are being greased(We know the Da.. but who is pushing this).

Trust me.. someone with a fat wallet and many tickets isn’t liking not being able to continue as per normal and driving on the coast on a long weekend and you can spot them on the wrong side of the road heading at you at >120km/h. my guess is an Uber ride to the holiday home is too pricey even for them.

No, I don't want points on my licence nor being denied a vehicle licence renewal because someone cloned my plates and I now have to prove my innocence or pay to be declared innocent. There is a reason for the constitution requiring the state to prove you guilty before they punish you. Want to start the slide down that slippery slope that lets the state punish you for something you haven't done?

And punishment has been turned into revenue gathering by AARTO instead of law enforcement with the checks and balances law enforcement should have.

No those okes will be fine. Pay a couple of kfc buckets at the local aarto office for their bonus points and off they go again. Its the honest folks who will be affected by these irrational laws.
 
Complex does not mean:
1-Intelligence.
2-Well thought out.
3-Sustainable.
4-Fair, Realistic, Solve problems.
5-Cheap, Resonable cost.
6-Parasitic in the long run, waisting time and resources.
7-Complicated abstract corruption can more easily hide in complex systems.

With abstract digital it is very easy to go complex, get carried away using digital in management systems, and if problems crop up its difficult to solve especially if it not a technical hardware problem, but needs re engineering & regroupings of knowledge to function well again.

Simplicity:
1-Kills corruption.
2-Reduce costs in all directions.
3-Easy to maintain. The brains behind complexity dissappear over time and those behind sit with a behemoth of a system costly to maintain.
4-Simplicity is hardly parsitic.

Couldn't agree more.
My biggest concern is that innocent motorists will get pulled over by corrupt law enforcement officials looking for a big fat bribe. This gives them the ability to have your license revoked without any proof. Think about how that may get abused.

Scenario:
You're on your way to the coast with the family in the car and get pulled over by a dodgy traffic cop. You're a single parent and the only driver in the car.

Cop: "I see you went over a solid line back there. That's 3 demerit points".
Cop: "I see your number plate is dirty. That's 3 demerit points"
You: "But they're not dirty."
Cop: "Yes, they are - look there are bugs stuck on the front plate - they're dirty".
Cop: "Your right indicator cover is faded and not roadworthy. That's 3 points"
...
12 points docked by bogus stuff made up. Now you are techically not licenced for three months and may not proceed with your trip to the coast.
The cop wants R5000 to "make your problems go away" which you don't have but you're stuck in the middle of the Karoo with two small kids in the car and if you lose your license for three months you'll also lose your job/income (travelling salesman).
What do you do?

Previously the cop would only have been able to issue a fine, you'd be on your way and could contest the fine later. Now they can have your licensed revoked on the spot. That's good leverage to extort money from the public.

It will Keep being another year after another year if you ask me.

They will keep delaying the implementation because it's too hard and it will also end up in court probably and be shot down in flames.
