Cold callers

BIL asks cold callers to hold on and leaves the phone lying on his desk, eventually they hang up.
 
I did this years ago and the only cold calls I get on my landline are Telkom Sales & "Microsoft Support" ...

I got a call from one of those Microsoft Support guys the other day, I think I sounded too excited because they disconnected right away, Pity because I was in the mood for a troll.
 
Those pre-recorded messages are seriously k$k, who in the hell is gonna be interested in that? Sorry, we are too scared you might abuse our telemarketers so here's a recorded message for you, tsek! But more than likely it's to save money while annoying people.
 
after the wife did a recent stint as a cold caller, i'm not such a d!ck to them any more. it's not the cold callers fault, but the company policy. so being a d!ck / jerk / ass hat to the cold caller is never going to solve the problem. use the do not contact list and take it up with company management.

They can be persistent though, even after you've asked for a supervisor they just carry on talking like you don't exist, I've only ever been able to speak to 1 supervisor out of 100s of cold calls and that was after asking them where they got my info from, and they said "National consumer database", then after pointing out that no such entity exists, I asked to speak to a supervisor or I would take legal steps for obtaining my info illegally, I was then immediately removed from their list by the supervisor, it was quiet for a while after that.
 
Unfortunately, you can do nothing against a company who does cold calling based on random numbers. There is no laws, not even Popi, preventing a company marketer from entering a random 10-digit number into a phone and phoning it with the aim to market a product or service.

What you can do is inform them not to call you again. In terms of the ECT they need to adhere to that request. Only if they phone you again will you have legal recourse against them if you kept all evidence of the first call and your request.

If you can prove the company accessed your information illegally from another source, then the ECT will also be able to assist you with actions. But, it will be up to you to prove it.

Popi mainly deals with how companies deal with personal identifiable information and where and how they obtain and access it. So, here you will need to prove that they obtained your information illegally and from where. If you can't, Popi will not be of much use either.
