Hi. Knowing that there are a good number (or a number of good) legals types on this site, I thought I'd pose the following:
My understanding of contract law is that there are a couple of fundamentals that have to be in place in order for a contract to be valid, e.g. capcity to enter into a contact, nature of contract is legal, i.e. you cannot contract someone to kill another, etc. But I also thought that there has to be an intent to uphold the contract too - good faith.
Does this last point void Telkom contracts? I enter into a contract with them based on the wording but they have a clause that allows for the contract to be changed. If I do not like the changes, I no longer have any intent to uphold the contract so it becomes void. Am I acting in bad faith? Is it even possible to have such a clause in a contract that actually isn't bad faith on the part of Telkom from the start - they have absolutely no intent of upholding the contract becuase they want to change it at their whim.
Or does this just get too technical - I've contracted at a price and I have accepted that there will be price adjustments into the future without needing to resign/ammend the contract every year?
