I have a evga p55 ftw mobo, i currently have i7 860 @2.8ghz, can i upgrade the processor alone?

Why would you do that? Upgrading to an i7 870 is not going to make a difference that you can notice. Rather replace the stock cooler with something that will allow you to overclock (eg CoolerMaster Hyper 212 Plus), and then run the 860 clock up a bit.
The new Sandybridge chips won't fit on your existing mobo, as far as I know.

I would actually recommend a much better cooler than the Hyper 212+ if you want to OC the i7 860, because my i7 860 sits at like 60'C when running at stock speeds, but this might just be due to my crappy case: CM Elite 430.

Agreed, overclock it untill it breaks. 4.2Ghz is possible with an H70... then you have the perfect excuse to upgrade.

i currently have the coolermaster v8 cpu cooler, i dont know how to overclock, would probably break it, would need to send it to someone who knew what they were doing, my machine sits at 30 - 45 normally about ten degrees above temp

Well now that's a shame! Take a look at this EVGA forum post http://www.evga.com/forums/tm.aspx?m=20029&mpage=1 - it's an EVGA P55 Overclocking Guide from an EVGA product manager. With pictures... :-)
As long as your BIOS allows recovery from an overly aggressive CO setting, you're not going to break anything - just suffer some frustration along the way. And if you don't get to 4.2GHz, that's OK too.
As a matter of interest, what temps are you seeing on your CPU? Pada's 60C seems rather high to me...

It's all in your BIOS. Overclock in small increments at a time. Although with modern CPU's you can go crazy with OC's! Test for stabilty with a CPU stress program. Repeat. Enjoy your slightly faster system which you probably won't notice (buy an SSD)

ya id probably prefer to buy a SSD than fiddle with settings its just taking forever for the prices to come down, still about R2900 for the 120gb OCZ vertex3

Download Intel Burn Test and Core Temp, go to overclock.net and search for your processor or your mobo and copy someone elses OC settings... run coretemp and then IBT for 10 runs on medium setting if you pass then lower your volts untill you fail.. then up the volts by 2 notches and you should be hunrdreds... if you go over 80C in IBT then I would lower the clock a bit... but most games arent nearly as demanding as IBT.
Perhaps run 3Dmark11 before and after your OC to see if there was an improvement... also lower your ram timings.

thanks for the advice, but ram timings and playinng with volts is a bit out my league lol
this made me run to the hills

Caution: Not for beginning overclockers. This program WILL stress the CPU, Memory, North Bridge, and other system components to their highest extent! Make sure your PC is properly cooled and ventilated!
Im not even a beginner

You can get an Intel 320 120gb for less - I would recommend that instead. The 40gb 320 goes for less than 1k.

i checked that EVGA page, i think i remember looking at that when i bought this rig, the only thing that stopped me was that he had put that setup to his memory, and i think mine was different so i didnt know what values to put in
