The Democratic Alliance on Monday gave Public Works Minister Thulas Nxesi 36 hours to explain under which law he "classified" the report into the Nkandla upgrade.

Party parliamentary leader Lindiwe Mazibuko said it remained unclear under which act the report was tagged "classified".

She said according to legal advice obtained by National Assembly Speaker Max Sisulu, a public works task team's report into the security upgrades at President Jacob Zuma's private home in Nkandla, KwaZulu-Natal, was classified.

"It is on this basis that the legal opinion, advising the Speaker to refer the report to a closed committee, was drafted by the State Law Adviser," said Mazibuko.

Mazibuko said the National Key Points Act did not give Nxesi the power to classify documents.

The minimum information security standards policy was a Cabinet document, and not a law that Nxesi could rely on to refer the report to the joint standing committee on intelligence (JSCI).

"This brings into question whether Minister Nxesi deliberately set out to hide the information contained in the report at the very outset, and whether he was wrong in requesting that the report be handled behind closed doors," Mazibuko said.

The JSCI is never open to the public due to the sensitive nature of information it discusses.

The committee is expected to discuss the report into the upgrade of the president's homestead on Wednesday.

"If he (Nxesi) does not respond before the commencement of the consideration of the report at JSCI on Wednesday, the DA will move a motion in the committee that the report be referred back to the minister for it to be made public and accordingly tabled before the appropriate public committee."

The DA wants to expose the ANC's corruption. They are fighting tooth and nail to do that. That's why it now has a reputation of "look at what the ANC has done". Not a good place to be for the leading opposition.

This is very worrying, that info bill is more and more threatening every day. This is one of the fears of the info bill, and it's looking like this was the intention all along for that bill...
 
I was wondering when we would be having a "DA said" article.

You should focus more on what is being said rather than who is saying it. It should concern you that R200 million rand can just be "classified" with no questions asked.

Go hide your head in the sand, turn on your blinkers .. bla bla bla .... Most tax payers would like to know where our money goes to... If you don't good for you. At least there is a party who is asking the correct questions. Truth hurts.... pfft classified report... what a joke. How "un-transparrent" the ANC has become.
