Dealership Problems

I recently (23 April) bought a BMW 320D from a dealership. A week later (1 May) the car red battery light started to show and the car died and don't want to start again. I called my Insurance and asked them to tow the car back to the dealership to get the problem fixed (I know now the problem is with the alternator).

They said there was something wrong with the battery and they replaced the battery. Today the exact same thing happened again and I need to tow the car again. The car has warranty. Am I responsible for the towing cost and anything the warranty doesn't cover or are the dealership responsible? I was fine covering the towing cost for the first time but they said they fixed the problem but obviously didn't.

Thanks for all future help

Doesn't BMW have on-call, where they send a mechanic out to you if you're stranded (and still on the motorplan)?

Are you still on motorplan?

Sorry forgot to mention the car is not on motorplan. And it's not towable because it is automatic.

Considering how recently you bought it, and the fact that they have already replaced the battery, I'd phone the dealer principal and tell him to send a mechanic over to sort it out or to send a flatbed to get it back to the dealership.

Already tried that, they say I'm responsible for getting it to them.

Don't even discuss it with the twit who answers the phone. Talk to the dealer principal. And mention that you've already started a discussion on the internet, but haven't mentioned the dealership's name yet.

So after towing my car to them at my expense, a week later (15 May) they call me and say I can collect my car today. Today they call me telling me they were standing at the petrol station with my car and one of those Coin trucks drove into my car . Anyone have any advice for me?

This must be an older model, as all new BMW's come with maintenance plan. How old is this car?

This car sounds like it's going to be trouble. You'll probably be better off getting a different vehicle.
What were they doing at the petrol station with your car? The car should not have left the dealership!

Yeah. Get a lawyer. They need to be held responsible for the damages. In fact, get them to take the car back and reimburse you what you paid for it. Buy something else.

Simple advice, you tell them they can either take the car back and refund you the money, or they can fix the car at a panel shop at their expense.

**EDIT**

Given that those Coin vehicles are not light or small, I would guess the damage is significant, therefore I would suggest you tell them they can keep the car and refund you the money.

It is a 2006 model. They want me to claim from my insurance and then my insurance can claim from their's

No. Plain and simple. That would massively effect your no-claims bonus and claim history, and not theirs.

Its their problem, you no longer want the vehicle as they have damaged it significantly and the vehicle is no longer "fit for purpose" as per the CPA.
