Demanding boss

current law says you are not allowed to work more than 10 hrs a week overtime these days, if i remember correctly
boss is like any other typical RSA boss, taking a fat ****ing chance, and getting away with it
Correct, if you do consistently work more than that, conditions are actually favourable for appointing an additional resource. But greed will be greed.

Get out there. Find another job first, but make it top priority. Not worth it.

If possible, try and find another job.

Agree 100%
In the 90s when i was in my 20's i too worked in IT for a small IT style company and i was on 24/7 call on my pager. I could literally never open a beer, i had to drop what i was doing on a Friday night at 11:30pm for example and get in my car and race 200km away to a Cantina Tequila to do a repair.

Eventually I left, and have never looked back. Small companies in IT are p03s !

The problem is that if you work for a smallish organization, there might not always even be a dedicated HR department. If you win a CCMA suit, your experience back at work might be a lot less pleasant than in the beginning. It's not right, but it's unfortunately how it is.
I was fortunate to have been part of a large organisation with a great HR department. They cared about employees and their wellbeing. I also work in the IT industry, but the organisation wasn't IT related. So we were a small IT team.
Working and reaching Management level myself, I realised more and more how most corporate departments are actually beneficial and required.

My last role was in a small organisation that had no dedicated HR. The Management was good at times and sorely lacking at other times. How I managed to pull through was due to the people I worked with. Great people and a good atmosphere. Finances and salaries were a mess. Here's to hoping for a better future for them and myself.

I had a **** manager too, went over all of them to the most senior manager and got a request to transfer, and guess what approved, that manager tried everything to keep me but no one was having any of her crap.

I have a very unpopular opinion on my work times: If you don't pay me for that time, I'm not working in that time.

I sometimes do, but only if it will benefit me. Example, I would really like to not sit with this project tomorrow morning, so I'll do the extra hour or so to get it done.

Thanks for the advise so far. Were a small team in a large company, we have an HR dept but the sentiment in the team is tht HR always chooses sides with management.

In terms of pay, we do get paid for all over time, but we would like to chose of we want to work a particular week or not. Frankly there are times when I rather want to live my life and go without the extra money for the month.

What really upsets me as well is that even if we do all this overtime, it's like it isnt enough - we are simply doing our job and dont deserve extra credit or recognition allegedly. Management always pushes that we must do more overtime - for different tasks and projects because we don't really have enough people but then makes it like we are not working as hard as other teams in the co. Frankly, I don't care if some other guy does twice as over time as me, I just want the optin of either working afterhours or just 9-5.

Finding other work is nt easy, especially in these corona times, but I will keep looking.

HR is supposed to be impartial.
If they aren't, mediation should occur with an entity like the CCMA.
By saying people shouldn't approach HR for serious matters is like saying everyone can be harassed (even sexually) with no consequences.
HR is there for a specific reason.

Well, if 2 layers of management agree they should be slave driven, hr opinion won’t be too far away... they’ll just put it to you in a nicer way.... that’s why I said send an anonymous email to the CEO and see what happens...

Anonymous emails won't help.
It's a small team. Everyone will know who sent it.

It looks like the OP needs to find a better job.

Anonymous email won't work. The previous company I was at, one of the IT guys send a anonymous email to the CEO and complained about management. Lets just say it didn't end well for him.
