Hi guys.
Haven't been on here for a length of time.

Need to ask if anyone can give some reliable information please.

Can another person stop someone from accessing their own bank account. Even if it's linked to a business account?

Long story.... Short.
My niece Lee had a breakdown. Some family members took over her life placed her in a hospital ( thankfully saving Lee's life)
Took her bank card etc handed over the Business account to her partner.
Now they stating if she goes to get a statement they will arrest her.
What bs....
Would it be in her legal rights to go get bank statement etc.
We get that she can't draw money from the business account but her personal account is linked to the business.

Any advice. Please and thank you in advance.
 
Not enough info, did they perhaps get a court to sign over her rights so that they can manage her affairs?

There are many ways to do it legally.
 
Lee must see a lawyer ASAP. Sounds like fraud. They can't just take over her stuff without power of attorney.

Best route to go. May not be fraud involved and their actions may be totally legal, but speak to an attorney who can provide proper legal advise.

Even with power of attorney. She can still revoke it. Permanent custodianship is the only order that can prevent Lee from accessing her accounts to my knowledge. I had power of attorney over my Parents and Standard Bank told me to take a Hike.

This surely required the said bank to formalize with proper procedure. One simply don't hand over accounts.

What gives?
 
All we can do is assume here as OP gave very little detail or context. Point is for something this serious you need to involve professionals. A good attorney who has full knowledge and context of the situation is the only one that will be able to give accurate input.
 
Not a lot of info provided but its sounds really dodgy. Like others have said its best to get legal advice and do things properly to have the best chance of a fair outcome. There are a few places that offer free legal assistance that might be able to assist.

Yeah depends on the situation, Free legal advice is extremely expensive in the long run, rather get a proper paid lawyer if that is not an option go the free route which is much better than where you are at now

By free I would mean proper law offices and universities that offer probono work.
