Domestic worker question.

Look, our domestic worker isn't THAT bad. We've had much much worse believe me. She's just... generally unsatisfactory in a number of the areas MrsC mentioned. Mainly she's not very bright at all, to the point that sometimes the effort it takes to get her to do what you want means you might as well have done it yourself.

So she is not able to perform the duties she is paid for?

Go try that at your job and see what your boss does about that.

You would probably get fired! Simply said. Ok, I will make some work of organizing a contract, and also chat to her, and give her a warning and get her to sign next to it.

From the website Labour protects, she must work more than 24 hours a month for me, and she works 32 hours for me a month, if it is a 4 week month, if 5 then she works over 40 hours a month. So I need to pay her UIF, and she gets 2 weeks notice, or then 2 weeks pay. Whichever she prefers. I must say, when I want her out, one wants her out, so I actually do prefer the 2 weeks pay. Cerebus and I will make work of it, and also setting out a set of rules she has to keep to!
 
I wouldn't bother with a contract and all that jazz - just write out a letter saying she is resigning, get her to sign it. And then give her severance pay and say it's because you don't need a maid anymore - the position is falling away.

Give her some notice so that she can find another job and then if she takes you to the CCMA the most they can ask you is 3 months pay - but she'll probably only get a month or two.
