Drawing up backdated contract for domestic worker

What reason?
She says she needs to submit it to some "garage" so as to buy a car for her brother. I asked how she is going to pay for it as she doesn't have a job with us anymore so she said I am still paying her so on that basis she will make a plan. I have made it clear that payment will stop after 2 more months. 6 months of severance pay is more than enough in my opinion and she has worked with us for 2 years and 3 months.

Eish, people have expectations.

Thanks, it will be pity if she takes us to CCMA. I will look up on UIF etc.
Don't worry, the waiting times at the CCMA are even longer! My guess is she wants to claim for TERS, so perhaps you can assist her with that - here are a multitude of tips and findings:

If you back date UIF, not having paid anything before, can you still claim?

Don't give it to her. Fall back on the BCE and leave it at that.

Probably but I don't get why she needs to claim. She is getting fully paid for complete month since lockdown started. I am going to draft a final settlement letter just to be safe.

The hilarity of the reality is that you are "robbing" her by paying her - because for every month that you do not pay her she stands to receive R3500 from the state. Details here:

I pay her 4.5K - how am I robbing her?

Now on that basis her request for documentation makes sense - any credit provider will request pay slips as well as a copy of contract.

She doesn't want copy of contract. I was looking to get it backdated so that I correct what I should have done earlier from a UIF perspective.

Have you taken a pay cut during lockdown? Have her hours been shortened due to lockdown?

Claim Ters, and you get reimbursed for the "advance" given to her.

I still pay my domestic her full salary (4.5k) but I claim back from TERS. She is still not back at work because her own family is high risk and I don't want/need her traveling in a taxi to get to work.

Register on ufliling. Then add domestic to your profile. Once that is all done you can apply via the Ters website.

Edit: you can't claim for April anymore, but make sure you have POP for submission to Ters to be able to claim for multiple months.

Thanks. Yeah, trying registering on ufiling since last month but no response.

Almost identical situation in our case.

I used a maid for quite a while. Then I realised that the kids in the house can do the same thing for a fraction of the cost.

Response?

It is all done online and pretty quick. Registered my wife in 30 minutes a couple weeks ago...
