A man caught allegedly stealing valuables from a house he had broken into was killed by the home owner in Mbewuleni location in Dutywa, Butterworth police said on Saturday.

Yolisa Dindili, 24, was severely assaulted by the house owner and died upon arrival at Dutywa Health Centre on Friday, Captain Jackson Manatha said.

"The suspect aged 35 was inside the house when he allegedly caught the deceased stealing some groceries, valuables of the house."

The man is expected to appear in the Dutywa Magistrate's Court on Monday on a murder charge.

Murder charge???? If the story is as it reads the criminal once again has more rights.

This quite a common debate here on MyBB... what happens when you catch an intruder in your home or on your property?

I think it is a standard procedure pending investigation and then a decision from the Public Prosecutor whether to proceed or not.
 
Bad policing is the cause. Rather investigate and then charge if needed. This is CYA charge hopefully.

How do they know that the intruder was only stealing groceries. He might nave been there to murder and rape? The home owner can just claim that the intruder came at him in a menacing manner and that he acted in self-defence ... case won!
 
I would say that is a hazard of the job, being a burglar. You never know when you might fall out of a window, or down stairs, or anything, especially if your health is not good to start with.

A good defence might be: "Satan struck him down for his sins"
