Excess usage clause (in the AUP)

No-one said anything about perfect. However, I cannot justify taking the risk of committing to a 24-month contract, and then getting badly burned 6 months down the line. It's really as simple as that; I'm not going to involve myself until I have a better idea of what the actual situation really is.

Just going back on to the topic quick. Last night I was thinking about the AUP and how in the contract you agree to to something that you do not have a hard copy that you sign at the time. Now this brings about some questions (yes they may be extreme but with the law thinking in these terms can sometimes save your ass down the line) first of all becuase you do not sign the AUP and it is not included in your contract what is stopping Sentech from changing the terms any time they feel like it, how can you prove what it said in the AUP at the time of signing ? I mean for all I know they could just as well put a cluase in there 1.5 years down the line that they now own all our possesions ? This might seam stupid but what are the laws regarding this ? I would find it interesting to get the oppinions of any legal people we have here or anyone with any experiance on this matter.

Ok maybe my example was an extreme one, but it still applies to any other changes Sentech could make without any consultation or contractual agreements to their customers, shuch as adding a Cap. port shaping, site blocking well just about anything ....

I have no experiance with legalities so I am really calling on anyone with experiance to get my facts straight. :P
 
Freakazoid, where are you? You offered in an earlier post to discuss issues raised with the Sentech yokels in your meeting, to which there's been no response? (See posting 5 and 16 on this topic) Appreciate you advising...

Contracts are not 100% law.

So if you get wipped to a 512 because of 'excessive' use.
You go to court stating that you had no idea what the norm was. And it isfor impossible you to know that you were using it excessively.
You also say that you will take this as a warning and calm down, but you request that they specify to you what the norm is.

The court will be on your side.
