Fired over Facebook

If I say Mr X is, for example, a serial rapist, then I must be able to provide proof of my assertment.

If I cannot, and Mr X loses his job, family and everything, and his quality of life is negatively influenced by what I said, then yes, he can sue me.

On the other hand, if he is a serial rapist, and I can prove it, then he can do nothing.

I know - it was just a joke :)

But it would be funny trying to prove it in court.... I have witnesses.
 
Sorry but people stupid enough to say this sort of thing on facebook deserve to be fired.

Be selective about which colleagues you have added.

Also this person was a dumbass at the end of the day.
 
I dont consider status updates to be in the public domain... Im not sure I approve of this, but the guy is paying for his mistakes. His mistake was to add non-friends / co-workers to his facebook profile.
 
So Wizard we can just go around calling people names and abusing them on facebook? i could understand if they went through his personal email account and found it but facebook is not exactly what you call private as such so the idiot lost his job over a stupid remark made about his boss. Sometimes it is better to shut up and do your work than worry if your boss is masturbating or care.

Good luck to him finding another job, sometimes stupidity can ruin lives.
 
there are alway 2 sides to a story sounds like his boss had had enough so used it as an excuse to get rid of him!

But is that any different to saying derogatory things at a braai with friends (where some work colleagues are present). If one of the work colleagues reports you to your boss, and you get fired, I wouldn’t be surprised if the same applies 9assuming the same background).
 
what happens if he was just making a joke, just saying it to sound funny ?

What happens if he just says he doesn't use facebook - they will have to prove that it was indeed him that posted it ? it's really easy to impersonate somebody on facebook - you just need an e-mail and a few photos ?

He could of been hacked even?
 
If he was good at his job, and he produced what he was asked to produce, why was he fired? AFAIK the boss doesn't own the employee, nor does he have any right to control what an employee says about him or the company... the employee is paid to do a certain job, and, if this job is done correctly and satisfactorily, the boss should pay the salary, and further shut-up and hands-off. Employees are not property!

Keep your work & private life separate I say.
Keep your facebook profile closed so only those that are invited can see it.

You could yes, but calling your boss a serial masturbater and saying insulting things about him to a public online social network is two WHOLLY seperate things.

the firing might have seemed unjustified, but depending on his contract with the employer, subboardination (sp) is usually a fireable offence. Respect is the call of the day here.

good riddance to such an employee anyway. if you dont like your job **** off and leave. your choice to stay, but bad mouthing people is just a poor sign of *** attitude

i think most people don't actually ever read their terms of employment that well. in essence, if your employer wanted to fire you they could find the smallest of things to build a case against you in no time.

eg i bet most of us who are employed are in breach of a number IT policy clauses by being on myBb but the employer looks the other way while you are still an asset to them.

Spot On.We actually get audited for breaches not only in terms of software but also policy. Reviews and feedback are completed for the law breakers and action taken upon that. For the most part its lenient but there have been some interesting cases.
 
A 23-year-old administration clerk at a clothing factory south of Durban lost his job after being reported by a co-worker for calling his boss a "serial masturbator" on Facebook.

Maybe the co-worker thought he'd get a promotion... and he probably did.
