Cape Town - A Western Cape High Court judge has ruled that the debt collecting procedure used by micro-lenders is “unconstitutional” and “an assault on human dignity”.

The application, brought by the University of Stellenbosch and the Legal Aid Clinic on behalf of 15 consumers, focused on the processes employed by micro-lenders to secure repayment of loans.

The University of Stellenbosch and the Legal Aid Clinic wanted the Emoluments Attachment Orders (EAOs) granted against the salaries of the 15 to be declared invalid. EAOs are more commonly known as garnishee orders.

“The individual applicants are a group of low income earners living in Stellenbosch, supporting themselves and their families on salaries of between R1 200 and R8 000 per month,” said Judge Siraj Desai.

“The group includes farmworkers, cleaners, and security guards. For debtors who work in low paid and vulnerable occupations, their salaries or wages are invariably their only asset and means of survival. A substantial reduction of this asset has the potential of reducing human dignity.”

He went on to say that the ability of people to earn an income and support themselves and their families is central to the right to human dignity.

According to the judgment, in terms of legislation, there is no statutory limit on the EAOs which may be granted against a debtor or the amount which may be deducted from his or her salary. However, in other countries, a limit was imposed on the amount of income that may be attached, said Desai.

He said the "depletion of a debtor’s income as a consequence of it being attached to pay a judgment debt may lead to the subsequent loss of other property such as a house or movable assets owned by the debtor".

“The reduction of a low earning debtor’s income has a direct impact on his right to shelter, health and family life,” said Desai.

What exactly does this ruling mean to other EAOs. Haven't read the entire ruling but does it refer only to these applicants or all other EAOs.

I do payroll and one of the most inconvenient thing is processing dozens of these every month. Many are not even compliant to begin with and I have to ensure that any EAO I receive is in fact valid. They main thing being that it must be granted by a court in the magisterial district where either the employee lives or works.

Well if the ruling says its unconstitutional, if the credit providers want to fight it I guess it will go to the constitutional court in the end

They have the persons sign something allowing them to do it in another district and some employers are not as diligent as you. The whole process is flawed, its magisterial clerks that sign off on them, no magistrates involved.

I am pro credit providers and that people should pay the debts they signed up for, but if the credit provider doesn't do their own due diligence, tough cookies for the credit provider.
 
I hope this is for all EAOs. I think this mechanism has been abused by micro lenders with reckless lending and high rates. They'll have to improve their game now ...

Jip, They phoned my mothers work for her details and how much she can afford to pay. the lady in payroll told them that she has not signed the admission of guilt and until then she will not give details ( perks of a small company)

To be honest though, SARS uses 3rd parties to collect money. Maybe they were trying to scare her or it's a scam. But in light of the situation she was in we took it quite seriously. ( thank goodness for the payroll lady)
 
Yes. But not in the same way. They issue a company an IT88 and instructs the company to deduct via payroll. If the company faults to comply, the company will be liable.

What happens is that when the company submits it's biannual EMP501 submission, SARS becomes aware of all current employees. SARS will then issue an IT88 to the company for any employees that has outstanding debt with SARS via their e@syfile software. Failure to comply with the order just causes the company more problems with SARS.

One more thing. I don't think SARS uses any third party collection companies. I have never dealt with any third party collecting on behalf of SARS. It was always with someone from SARS with a SARS.gov.za email address.

Now this is from someone that worked with SARS. The very old things. ( my mothers is from something like 1992 ) they outsource it. Try and make people pay up. Listen I don't want to derail this thread with this story.

I was just wondering if it would apply to SARS. But I guess the answer would be no. Nothing like this ever applies to anything that would make the party fund smaller. :D
