Geyser warranty

Background story:
In 2011 we installed 300l solar geyser with evacuated tubes, 10 year warranty was one of the reasons why we selected particular brand.
End of January geyser burst, we contacted insurance which directed us to the geyser manufacturer.
Appointed plumbing company informed us that there is no stock of needed 300l due to manufacturing issues.

They started production beginning of February and we were patiently waiting in a queue of 19 unfortunate souls.
Turns out that they stopped production again two weeks ago due to lack of outer shell material, apparently their supplier is waiting for stock.
There is no delivery date specified except that they will deliver it one day.

We thought of buying another geyser and claim from manufacturer but they claim that they are only obliged to pay up to value of reminding warranty, basically 40% of price.

Other option I thought was to take them to small claims court but they say that this will void warranty. (actually price of geyser is over R15k)

I rigged some sort of camping shower with warm water but it is not ideal and clumsy to operate.
Kids had cold already due to it.

What are our options?
Can insurance do something?
Anybody had similar problem with resolution?
 
How can you going to small claims court void warranty? They obviously telling you this cos they going to lose the case and fork out a lot of cash especially if others jump on your bandwagon.
 
Check the fine print for some or clause. But if such a clause exists, it should be null and void anyway if I understand the CPA correctly?
 
There was a solar geyser company in our local newspaper recently using similiar tactics and never actually replacing/repairing the geyser - for your sake, I hope its not them.

^^ This - also why is the insurance sending you to the manufacturer they should replace this with one of equal value ?
 
If your geyser actually burst it is an insurance issue as this is covered under your Home Owners insurance. However some insurers require that you specify a solar geyser and pay extra for it as it is in some ways more exposed to the elements ie Hail.

If you actually did specify it then the insurers have to pay out and claim from the manufacturer because they collected and accepted the premium/risk.

It seems this company is parent company of one went down in CT.

I will contact insurers again.

Geyser is under the roof so there is no exposure to the elements.

Yip - sounding like the article in the newspaper.
 
I'll post geyser info later on.

Contacted insurance and they put wheels in the motion, if all goes well they might sort it out.
 
Quick update, geyser was solar term 300l by w.e. geysers.

They did not dispute warranty but just had excuse after excuse (factory closed, lack of materials).
Not sure how factual these excuses are but after 2 months without hot water we decided that insurance must sort it out.

Insurance guys were great and plumbers are installing new geyser today.
Different brand with hopefully better warranty and service.

checking out Hellopeter for W.E Geysers and the complaints all seem to go the same way, they don't honour the garuntee

Fark, had the same 300l geyser burst a month ago.
Insurance had the replacement installed - same brand again

Hope i dont have issues a few years down the line with them again

You are lucky that you actually got one!!

Finally we have hot water!!

Regarding brands I had Kwikot geysers before that burst, their service was brilliant, no disputes just showed next day and replaced the unit.

Actually didn't get to go through with the warranty as the warranty plate on the geyser somehow managed to fall off.

Was without hot water for a week after having 3 plumbers to come inspect. Each one with different items that needed to be replaced.
